WG and our industry allies are working to stop the passage of the UFW bill SB 25 (Steinberg, D-Sacramento) when it is considered on the Assembly Floor. This bill eliminates the need for employers and employees to bargain and will result in perpetual mediation. The following points highlight the problems with SB 25.
•SB 25 results in the disenfranchisement of agricultural workers because the contract developed by the mediator is final and NOT subject to worker ratification.
•SB 25 would allow a party to drag out negotiations for a 60-day period and then call for a mediator to impose the terms and conditions of a renewal contract. Negotiating and bargaining would become a thing of the past.
•SB 25 denies due process and limits a party’s ability to appeal a mediator’s contractual terms by requiring a clear and convincing evidence standard of proof making it virtually impossible for a court of appeal to become involved.
