WHAT MUST MY CUSTOMER DO TO PROPERLY REJECT?

It is important to understand your obligations as well as rights as a shipper. A shipment cannot be rejected if it is either:

  1. Unloaded (except for the purpose of inspection), or
  2. Diverted during transit

Both such actions constitute acceptance. For proper cause, your buyer may reject a shipment by providing a prompt and proper notification to you, the shipper. The PACA defines timeliness in rejecting a shipment as:
