Western Growers Comments on Proposed H-2A Rules

As we reported here, the U.S. Department of Labor, Employment and Training Administration and Wage and Hour Division posted a Notice of Proposed Rulemaking (NPRM) to solicit public comment on proposed changes to improve the H-2A temporary agricultural labor certification program for the first time since 2010.

In comments submitted by Western Growers, the Grower-Shipper Association of Santa Barbara and San Luis Obispo Counties, the Grower-Shipper Association of Central California, and Ventura County Agricultural Association, on September 24, 2019, the associations lauded DOL’s efforts to streamline and modernize the H-2A program, supporting specific proposed rule changes that will reduce unnecessary cost, inefficiency and frustration that now is part of the program.  The comment letter also objects to provisions that are inconsistent with the Administration’s stated intent to improve the program.
