If the answer is "Yes", then you and your customer definitely need to be members of the Fruit and Vegetable Dispute and Resolution Corporation (DRC).  If you should ever encounter a dispute with one of your customers in Canada, aside from taking expensive legal action, the only remedy for effectively, economically and quickly resolving a contract dispute is to submit the matter to the DRC for handling.

What are the advantages of sending your product to a wholesaler on a price after sale basis (PAS) vs. a consignment? First of all, let’s define what the two sales terms actually mean.

  • Price after Sale is not defined under the Perishable Agricultural Commodities Act, but is similar to Open. This term is generally interpreted to mean that the parties will agree on a price after the buyer completes the sale of the product.

A scenario that continuously comes into play when I’m dealing with a disputed load is when product arrives at the contract destination with condition defects and the temperature recording device cannot be located.   In virtually all cases the trucker has signed for the temperature recording device, which is normally printed on the Bill of Lading, yet for some unknown reason the receiver and/or carrier claim temperature recording device cannot be located.
