H-2A Visa Leeway Extended Into 2023

The U.S. Department of Homeland Security (DHS) will extend the amendments to certain regulations regarding H–2A workers to August 2023, to provide employers flexibility in hiring workers during the COVID-19 pandemic.

Through this temporary final rule, DHS will allow employees with valid extension of stay H-2A petitions to begin work with a new employer immediately after their petition is received by the U.S. Citizenship and Immigration Services. This rule extends some of the provisions made possible with the April 20, 2020, temporary final rule. This rule is effective for H-2A petitions for extension of stay received by the Department from August 19, 2020, through December 17, 2020.
