Videos Promote Western Growers Transportation Program

Along with C.H. Robinson, our strategic partners in Western Growers Transportation Program, two recent videos have been produced that highlight the benefits from members’ use of the program. The videos, featuring The Wonderful Company and Dulcinea, function as testimonials to the reliability of the program and are being featured on both C.H. Robinson’s and WGs’ web and social media pages.

Center for Produce Safety Announces $20M Fundraising Initiative

The Center for Produce Safety (CPS) issued a press release today announcing the “Campaign for Produce Safety,” a major fundraising initiative designed to secure $20 million in funding over the next five years.

Social Media Helps Get the Story Out

Today’s VICE News piece, Flooding Fields in California’s Drought, epitomizes “journalism” at its worst.  The hit piece on California farmers’ water use provided little balance to a story that is misleading and, at times, nonfactual.  

The California Farm Water Coalition issued a fantastic response on its webpage dispelling many of the assertions made in the piece. It also posted the response on Twitter to its 4000+ followers and for anyone else who happened upon it in the Twitter-verse. With WG and others “retweeting” and “favoriting” their post, we were able to exponentially reach multitudes of other Twitter followers by using the #cawater and #cadrought hashtags.

Unless you have been locked in a closet for the last 10 years, most people and businesses understand that social media, in its many forms, has become a tremendously valuable tool to help get information and messaging out to key audiences. However, social media is often underutilized as an effective communications medium because it can be misunderstood and underestimated.

Western Growers is making a concerted effort to ramp up our social media activities. Our presence on social media platforms such as Twitter, Facebook, LinkedIn, and YouTube help us spread news and information quickly (and to counter the type of misinformation we saw from VICE News). Along with our counterparts at the California Farm Water Coalition, we took to the internet today to pass along “our side of the story” on this negative piece.

Pollution Liability-Forgotten, But Needed Coverage

Most companies are very aware of their property and liability exposures. They buy insurance coverage to protect their buildings and equipment and secure liability coverage to pay for losses from automobile accidents, product defects and other types of third party incidents. What most companies fail to realize is that they may have pollution exposures as well from chemical or fuel use in its operations. Transportation of fuel, fertilizers, pesticides and other chemicals to multiple locations carries with it the risk that an accident causes the materials to be spilled on their own other someone else’s property. 

Most standard liability policies – general liability or automobile liability – specifically exclude pollution losses. Other liability policies such as ’Directors and Officers’ or ’Errors and Omissions’ also typically have specific exclusions for pollution events. The only way to properly protect your company from a pollution event is to buy a pollution legal liability policy. This type of policy can provide coverage for pollution clean-up, business interruption and liability to third parties who might be affected by your pollution accident. Even if you only use the chemicals or fuel on your own property, if they are stored in tanks on your property, you may have exposures that can only be covered by a pollution liability policy.

Tom Papa to Perform During the 90th Annual Meeting Award of Honor Dinner

September 3rd, 2015

Comedian Tom Papa will be the performer during the entertainment portion of this year’s Award of Honor Dinner. Papa, a 20 plus–year veteran in stand-up comedy, has been showcased in a variety of entertainment mediums that include the silver screen, TV, radio, and the live stage. His first hour-long special, Tom Papa Live in New York City, premiered on Comedy Central in January of 2012 and was followed by a second special, Tom Papa: Freaked Out, in 2013. That special was named one of the 10 Best Comedy Albums of 2013 by Laughspin.com. He has also been seen in the hit Comedy Central series, Inside Amy Schumer.  

Papa has several film credits to his name. He appeared in the HBO movie, Behind the Candelabra, with Michael Douglas and Matt Damon – a film that won 11 Emmy’s. He also appeared in another Damon film, The Informant. Robert DeNiro played opposite of Papa in the movies, Analyze That and Comedian. His film career includes voiceover work in animated movies such as, The Haunted World of El Superbeasto and Bee Movie, where he was also credited as a writer.  

Tom can be seen alongside Clive Owen in Steven Soderbergh’s, The Knick, on Cinemax and he will be seen in the highly anticipated Chris Rock film, Top Five. In 2015, Tom will host the new FOX TV game show, Boom!.

Papa was personally chosen by Jerry Seinfeld to host the NBC series, The Marriage Ref and had a reoccurring role opposite of Julia Louis-Dreyfus on the CBS series, The New Adventures of Old Christine.  He also starred in his own NBC series, Come to Papa.

Tom is host of the hit SiriusXM show, Come to Papa, which airs on channel 99. The weekly, hour-long program features extended interviews with comedians, including Mel Brooks, Ray Romano, Carl Reiner and Jerry Seinfeld, and live, scripted radio plays. Tom has been a regular guest on The Tonight Show with Jay Leno, Conan, and The Late Show with David Letterman. When not touring the country, Tom lives in New York and Los Angeles with his wife and family.

Weather Service Issues High Heat Advisory Warning

September 8th, 2015

The National Weather Service has issued a high heat advisory, as above-normal temperatures will make it feel more like summer than early fall along much of the California coast. Outdoor employers are reminded to:

  • Provide workers with plenty of fresh, cool and accessible water;
  • Encourage and remind workers to drink water before they become thirsty and about every 15 minutes;
  • Allow workers to acclimatize to heat conditions by gradually increasing exposure over a five-day work period and by implementing more frequent breaks during the first week of work in those conditions;
  • Monitor weather reports daily and reschedule jobs with high heat exposure to cooler times of the day;
  • Monitor workers for signs and symptoms of heat exposure and encourage employees to report symptoms of any heat-related illnesses;
  • Frequently train workers and supervisors about the hazards leading to heat stress and ways to prevent them;
  • Implement an emergency plan and ensure supervisors know what to do if someone is experiencing symptoms of heat illness;
  • Provide a 10-minute rest break every two hours during periods of high heat.

FDA Finalizes Preventive Controls for Human Food Rule

Today, the Food and Drug Administration (FDA) announced that two rules developed as a result of the passage of the Food Safety Modernization Act in 2011 have been finalized. The Preventive Controls for Human Food rule and the Preventive Controls for Animal Food rule require companies that process food for humans and animals to implement safety plans that identify, prevent or minimize food safety hazards. According to the FDA, ”some compliance dates for some businesses begin in September 2016.” 

The Food and Safety Modernization Act (FSMA) is the most significant food safety legislation implemented since early last century.  The legislation is a paradigm shift in food safety strategies, requiring preventative safety initiatives rather than reactionary ones. The FDA is expected to finalize five additional rules as the result of the passage of FSMA.

FDA is hosting a series of webinars next week on the Preventative Control Rules. Registration for the webinars is not necessary. Slides will be posted prior to each webinar on this page. Recordings will be made available.

2015 California Legislative Update

September 15th, 2015

The 2015 California legislative year was completed early Saturday morning following final action on bills. The focus now shifts as the governor will decide the fate of the bills that were passed. Below is a brief snapshot of key bills of importance to WG.

AB 465 (Roger Hernandez, D – West Covina) Oppose: AB 465 would preclude the use of mandatory employment arbitration agreements. Although likely pre-empted by the Federal Arbitration Act, the bill was passed by the Legislature. Increased litigation and class actions would be likely if this bill is approved. WG and a large employer coalition are requesting that AB 465 be vetoed.

AB 561 (Campos, D – San Jose) Oppose: This bill would require the Agricultural Labor Relations Board (ALRB) to process to final board order all decisions concerning make-whole awards, backpay, and other monetary awards to employees within one year of any ALRB order. AB 561 would also require an employer seeking a writ of review of any Board decision involving make-whole, backpay, or other monetary awards to first post a bond in the amount of the entire economic value of the order as determined by the Board. The bill was passed and WG is seeking a veto by the governor.

AB 1390 (Alejo, D – Watsonville) and SB 226 (Pavley, D – Agoura Hills) Support:  These measures together fulfill the governor’s determination, articulated in his signing statement from last year for the Sustainable Groundwater Management Act (SGMA), to streamline groundwater basin adjudications.  AB 1390 adds a new chapter to the Code of Civil Procedure that will establish procedures for legal actions to comprehensively adjudicate rights to groundwater in a basin. Streamlining the process will ease the burden on the courts, provide the parties with the most efficient resolution possible and protect individual rights. SB 226 adds a new chapter to the Water Code and will work in conjunction with AB 1390 to provide the necessary policy changes to SGMA to accommodate and coordinate future adjudications in high and medium priority basins. Because AB 1390 and SB 226 are purely procedural bills, they do not alter groundwater rights or hinder SGMA or the SGMA process. Republicans joined Democrats in approving both bills unanimously in the state Senate and with only three dissenting votes to SB 226 in the Assembly.

AB 1506 (Roger Hernandez, D – West Covina) Support: This bill would amend the Labor Code Private Attorney General Act of 2004 (PAGA) to provide an employer with the right to cure a violation of failing to provide its employees with a wage statement containing the inclusive dates of the pay period and the name and address of the legal entity that is the employer. The bill would limit the employer’s right to cure to once per 12-month period. AB 1506 was passed by the Legislature and WG is part of a large coalition requesting its approval by the governor.

AB 1513 (Williams, D – Santa Barbara) Support if Amended: This bill provides an affirmative defense and safe harbor for employers who, by December 15, 2016, fully compensate piece rate employees for all under-compensated rest periods, recovery periods, or unproductive time between July 1, 2012 and December 31, 2015.  This legislation emerged following a flood of class-action lawsuits against growers exposed to huge civil penalties and liquidated damages due to appellate court rulings that changed long-accepted practice for payment of rest periods and other nonproductive time for piece rate employees. WG maintained a support if amended position on the bill, arguing for removal of a provision, added at the insistence of the UFW, that targets one company.  The provision prevents the company from accessing the safe harbor protection from class action litigation due to unproven allegations in an unrelated wage and hour case. Unfortunately, this amendment was not taken.  The bill was passed and will be signed by the governor.

SB 3 (Leno, D – San Francisco) Oppose: This bill would increase the minimum wage on January 1, 2016 to $11 per hour, and on July 1, 2017, to $13 per hour. Beginning January 1, 2019, the minimum wage would be annually adjusted using the California Consumer Price Index. WG was part of a large employer coalition opposing SB 3. The bill was stopped in the Assembly Committee on Appropriations and remains eligible for further action next year. Democratic leaders have indicated that they would like to see the minimum wage increased to $15 per hour. Labor unions have filed a ballot initiative increasing the minimum wage and indexing it to inflation.

SB 32 (Pavley, D – Agoura Hills) Oppose: This bill originally required the California Air Resources Board to approve statewide greenhouse gas emissions limits that are the equivalent of 40% below the 1990 level to be achieved by 2030 and 80% below the 1990 level to be achieved by 2050. Strong opposition from a large coalition of industry groups including WG and a sizeable group of moderate Democrats in the Assembly compelled the author to drop the 80% mandate and hold the bill in the Assembly Committee on Natural Resources. Senator Pavley has stated that she will continue to advocate for the greenhouse gas emissions reduction mandate next year.

SB 350 (De Leon, D – Los Angeles) Oppose: WG has been part of a large coalition opposing SB 350 because it would significantly increase energy costs by expanding three clean-energy goals to be achieved by 2030. Original language in the bill would have required a 50% reduction in petroleum use in the state, increasing the Renewable Portfolio Standard to 50%, and increasing energy efficiency in buildings by 50%. Following heavy multi-industry sector opposition and engagement by moderate Democrats in the Assembly, the 50% petroleum mandate was removed from the bill last week. SB 350 was passed in its reduced form by the Legislature and is awaiting a certain signature by the governor.

FSMA –Preventive Controls for Human Food Webinar THIS FRIDAY

With the publication of FDA’s final Food Safety Modernization Act (FSMA) rule for Preventive Controls for Human Food and Animal Feed, the produce industry has come together to provide a FREE series of webinars to help industry members understand the final rules and implications for their businesses.

FDA’s final FSMA regulations will have a significant impact on how the produce industry does business. The first two major FSMA regulations, Preventive Controls for Human Food and Animal Feed, have recently been published and five other major FSMA final regulations are anticipated in the coming months. Understanding which businesses are covered by these regulations and how the provisions of each regulation applies to your specific operation is the first step in being prepared to be compliant with these new regulations. 

In an effort to ensure industry members are well informed and have an opportunity to ask questions directly of FDA about these new regulations, we are inviting you to participate in these webinars.

90th Annual Meeting – Get Inspired by Top Chef Shirley Chung

When “chef-testant,” Shirley Chung was eliminated from the Top Chef show’s final four episode in Hawaii in 2014, she graciously lamented about her performance saying, “I feel like I disappointed a lot of people, but I have to be honest and say that I agreed with the judges. I was simply not at my best caliber for the end of the competition or for the dish. Everything went wrong. It totally wasn’t my day.” A fan favorite, Chung had more than her share of triumphs during the season, having won several elimination competitions, producing dishes that were considered some of the judge’s favorites. There were uproars from the fans who believed one of the other “chef-testants” should have been eliminated instead.

Chung, also known as Chef Shirley, blamed part of her failure that day on some mishaps while cooking and presenting, and not having vegetables for one of her race competitions. “I had pork, sweet potato, turmeric and honey, but it was starch on starch on starch,” she said in an interview with the Las Vegas Sun. Considering Chef Shirley will be leading one of Western Growers’ workshops during our Annual Meeting in November, we know she will have plenty of vegetables on hand to delight attendees with tasty, healthy dishes.

Despite the Hawaiian trade winds not being in her favor that day, Chung has taken that experience and moved on in her career. According to the article, she thought the results that day were a ”big win and not a loss.” Chef Shirley said she found her voice and the experience made her realize that although she spent more time in the management-side in restaurants, she now knows she can really cook. She calls her style of cooking “modern American cuisine with a Chinese soul.” Diners in Orange County can taste first-hand her inspirational and innovative menu of fun and shareable plates at her restaurant in Irvine called “Twenty Eight.”

Yuma Ag Center to Host Fusarium Conference in November

The University of Arizona’s Yuma Center of Excellence for Desert Agriculture is hosting a Fusarium Wilt Conference on Wednesday, November 12, 2015. The Conference will take place in Yuma and run through Friday, November 13. 

Attendees will hear from Fusarium Wilt experts from Arizona, California, Italy and Brazil and will also have the opportunity to take a field trip to see first-hand of how Fusarium Wilt solutions are put into practice.
