USDA Adds More Eligible Crops for CFAP, Extends Deadline

On Tuesday, August 11, the U.S. Department of Agriculture (USDA) announced the inclusion of additional eligible crops in the Coronavirus Food Assistance Program (CFAP). USDA is also extending the deadline to apply for the program to Friday, September 11. The timeframe for eligible losses continues to be January 15 – April 15, 2020. The full announcement and details can be viewed here.

The newly eligible crops are: aloe leaves, bananas, batatas, bok choy, carambola (star fruit), cherimoya, chervil (french parsley), citron, curry leaves, cut flowers, daikon, dates, dill, donqua (winter melon), dragon fruit (red pitaya), endive, escarole, filberts, frisee, horseradish, kohlrabi, kumquats, leeks, mamey sapote, maple sap (for maple syrup), mesculin mix, microgreens, nectarines, nursery crops, parsley, persimmons, plantains, pomegranates, pummelos, pumpkins, rutabagas, shallots, tangelos, turnips/celeriac, turmeric, upland/winter cress, water cress, yautia/malanga, and yuca/cassava.

The following changes to CFAP have also been made:

  • Green onions, pistachios, peppermint, spearmint, walnuts and watermelons are now eligible for ‘Category 1’ payments for sales losses. Originally, these commodities were only eligible for Categories 2 and 3 payments for marketing adjustments. The respective payment rates for these crops have been adjusted accordingly.
  • Producers who newly apply for CFAP going forward will receive 100% of their total payment  (not to exceed the payment limit) when their applications are approved. For already-approved applicants that received, or will soon receive, their initial 80% payment, the Farm Service Agency (FSA) will automatically approve and issue the remaining 20%.

Interested producers, especially those who have not worked with FSA previously, are recommended to call 877-508-8364 to begin the application process. An FSA staff member can help producers start their application during the phone call. They are also encouraged to visit farmers.gov/cfap for additional resources and form templates.

As of August 10, specialty crop growers nationwide have received just over $305 million in CFAP payments – only 4% of all approved payouts from the $16 billion program. Among Western Growers’ home states of California, Arizona, New Mexico and Colorado, roughly $127 million has been paid out to fresh fruit, vegetable, and tree nut growers. Western Growers members are encouraged to explore the USDA direct payment program to determine eligibility.

Consult Tax Advisor Prior to Applying for PPP Loan Forgiveness

The CARES Act provides for the forgiveness of Paycheck Protection Program (PPP) loans that are used for certain payroll-related costs, or covered expenses, and makes clear that forgiven loans are to be excluded from gross income.

However, the CARES Act does not address the deductibility of covered expenses, which has prompted the IRS to issue a notice (2020-32) stating that any forgiven PPP loans used for covered expenses will not be deductible, which appears to undercut Congressional intent in designing the relief program.

Efforts are under way to secure a Congressional fix. Until such legislative clarification is realized, Western Growers members are encouraged to speak with their tax advisor prior to applying for PPP loan forgiveness, as doing so may preclude the applicant from any potential retroactive correction.

Western Growers has joined a national coalition of business and agricultural groups in calling on Congress to include a technical correction ensuring tax-free PPP loan forgiveness in the next round of COVID-19 relief.

“Denying the correct tax treatment of these loans will result in hardship for many struggling businesses,” the coalition states in a letter to Congressional leadership.

The letter concludes: “As part of the next round of COVID-19 relief, we request that Congress reaffirm its intent and restore the tax benefits it intended to give distressed Main Street businesses as part of the CARES Act.”

USDA to Host CFAP Producer Webinar August 19

The U.S. Department of Agriculture (USDA) will host a webinar on August 19 at 3 p.m. ET to discuss recently added commodities eligible for the Coronavirus Food Assistance Program (CFAP).

USDA is extending the deadline to apply for the program to September 11, 2020, and producers with approved applications will receive their final payment. The CFAP program helps offset price declines and additional marketing costs because of the coronavirus pandemic.

Congressman Panetta Leads Call for Assistance in Securing N-95 Masks

August 25th, 2020

Congressmen Jimmy Panetta (CA-20) and Doug LaMalfa (CA-01) headline a bipartisan letter to Vice President Mike Pence, as head of the White House Coronavirus Task Force, requesting immediate assistance in securing safety equipment, including N-95 masks, for farmers and farmworkers impacted by the wildfire smoke.

“Such essential equipment will help protect those who continue to produce our agricultural products and contribute so much to our nation’s food security,” the letter states.

The letter references the heat wave in California, which has dried the landscape and made it more susceptible to fire. To date in 2020, 7,330 wildfires have burned 1.1 million acres across the state.

In California, emergency regulations stipulate that, in workplace settings with significant wildfire smoke exposure, when the current Air Quality Index (AQI) for PM2.5 particulate is 151 or greater, employers must provide proper respiratory protection equipment to their employees. Many areas along the central coast of California have already surpassed this AQI threshold.

“Unfortunately, agricultural producers are struggling to procure the necessary masks, given limited supplies and backlogs at the national level,” the letter continues.

With the combination of the COVID-19 pandemic and the 2020 wildfire season, the letter requests the Task Force to, “work with relevant state and federal agencies to ensure America’s farmers and farmworkers have priority access to the protective gear they need to do their essential work, including N-95 or equivalent facial masks.”

Tips to Prevent Heat Illness During Period of High Heat

Western Growers encourages all members to review high heat advisories and take steps to prevent heat illness.

Cal/OSHA suggests employers with outdoor workers do the following to prevent heat illness:

  • Plan – Develop and implement an effective written heat illness prevention plan that includes emergency response procedures.
  • Training – Train all employees and supervisors on heat illness prevention.
  • Water – Provide drinking water that is fresh, pure, suitably cool and free of charge so that each worker can drink at least 1 quart per hour, and encourage workers to do so.
  • Shade – Provide shade when temperatures exceed 80˚ F or when workers request it. Shade must be available even when temperatures do not exceed 80 degrees. Encourage workers to take a cool-down rest in the shade for at least five minutes when they feel the need to do so. They should not wait until they feel sick to cool down.
  • Space – Allow enough space and time for employees to take breaks as needed in adequate shade while also maintaining a safe distance from one another; for many employers this will require staggered breaks or increased shaded break areas, or both.
  • Cleanse – Extra infection prevention measures should be in place such as disinfecting commonly touched surfaces, including the water and restroom facilities.
  • Face Coverings – Provide cloth face coverings or allow workers to use their own; they should be removed in outdoor high heat conditions to help prevent overheating as long as physical distancing can be maintained.

USCIS Announces Changes to Visa Petition Fees

On August 3, 2020, the United States Citizenship and Immigration Services (USCIS) issued a Final Rule, which will impact the filing fees for many petitions, including H-2A petitions. Though the standard fee to file for any number of unnamed H-2A workers will decrease, the Rule includes dramatic fee increases for petitions that extend the stay for workers already in the U.S. or transfer to a new H-2A temporary labor certification. The new fees will be effective October 2, 2020.

After the U.S. Department of Labor certifies an application for H-2A temporary labor, the employer must file a form I-129, petition for nonimmigrant visas with USCIS. Typically, H-2A employers file petitions for new unnamed beneficiaries. The current fee for I-129 filings is $460. The final rule reduces the fee for unnamed beneficiary petitions at $415. However, for named beneficiary petitions, typically used for H-2A worker extensions and transfers, the final rule creates a new fee tier at $860. The rule also limits the number of named beneficiaries to 25 individuals per filing. Unnamed beneficiary petitions have no cap on the number of workers requested. 

The increases appear to be driven by the budget shortfall USCIS has experienced due to a reduction in the number of filings of petitions and applications. Most employer sponsored and individual visa programs will experience higher fees going forward.  The new

The rule will take effect 60 days after publication, so any I-129s filed on or after October 2, 2020 will be required to include the new fee amount and comply with the named beneficiary limit.

In addition, USCIS will publish revised versions of several petition and application forms within 30 days, including Form I-129.

Industry Trailblazer Jack Woolf Passes Away at 102

August 4th, 2020

John “Jack” Leroy Woolf Jr., industry pioneer and prominent Fresno-area farmer, has passed away at the age of 102.

Woolf, who launched Woolf Farming Company in 1974, was among the first to plant almonds and pistachios in California’s Fresno County, a leading commodity that generates billions of dollars in revenue for the region every year.

After graduating from the Woodbury Business College in Los Angeles and serving in the Army during World War II, in which he earned seven battle stars, Woolf returned to California and went to work for Giffen, Inc., a position he would hold for three decades. When Russell Giffen retired in 1974, Woolf and his wife, Bernice, bought some of his farmland and the Woolf Farming Company was born.

While he started out growing cotton, grain and melons, Woolf soon began to diversify, moving into processing tomatoes and tree nuts, all while maintaining a focus on water efficiency. His leadership abilities were sought out on numerous boards, including the Westlands Water District Board of Directors, where he served from 1976 to 1992.

Woolf is widely recognized for his role in helping to transform the agricultural face of the San Joaquin Valley. His legacy will be continued by his wife and six children, including Stuart Woolf, President and CEO of Woolf Farming & Processing and current Vice Chairman of the Western Growers Board of Directors.

FDA Virtual Town Hall: New Era of Smarter Food Safety Blueprint

On August 26, the Food and Beverage Issue Alliance and the Consumer Brands Association will host a town hall with Federal Drug Administration (FDA) Deputy Commissioner Frank Yiannas to discuss the New Era of Smarter Food Safety Blueprint. Yiannas will provide details on the blueprint followed by a Q&A to answer any audience questions.

Governor Newsom Urges Businesses to Use Backup Energy Sources During Heat Wave

August 18th, 2020

With the West Coast heat wave projected to intensify over the coming days, Governor Gavin Newsom is calling on Californians to limit power usage during peak times, and is urging businesses to use backup energy sources to relieve pressure on the grid.

In an Executive Order earlier this week, Newsom proclaimed a State of Emergency, and temporarily suspended permitting requirements “that restrict the amount of power a facility may generate, restrict the amount of fuel that a facility may use, or impose air quality requirements that prevent the facility from generating additional power during peak demand hours from 3:00 p.m. to 10:00 p.m.”

According to the Executive Order: “Any facility that operates in violation of the suspended permitting requirements must notify the relevant local air quality management district, the Energy Commission, and the Air Resources Board of its actions within 48 hours and report additional fuel use, additional hours of operation, and energy produced by that additional use and operation to the relevant local air quality management district, the Energy Commission, and the Air Resources Board within 30 days.”

The temporary suspension expires at 11:59 p.m. on August 20, 2020 (Thursday night).

Worker Health and Safety Best Practices Webinar on 08/27

Western Growers members are invited to attend the “COVID-19, Cal/OSHA, and Agriculture…What You Need to Know as an Employer” Webinar on August 27 to learn how to enhance worker health and safety during the COVID-19 pandemic.

Cal/OSHA is reminding employers the importance of worker health and safety during this current pandemic. Although Cal/OSHA does not have specific regulations regarding COVID-19 for the industry, there are regulations employers must adhere to in order to ensure their workforces’ health and safety.

The webinar, which is hosted by Cal/OSHA Consultation Services, will address employer responsibilities in implementing their Injury and Illness Prevention Program, COVID-19 plans, as well as industry best practices.
