FDA Develops Guidance Documents in Collaboration with Western Growers

On Tuesday morning, the U.S. Food & Drug Administration’s (FDA) Center for Food Safety and Applied Nutrition published a Constituent Update that discussed “How to Work with FDA on Food Guidance Documents.”

The update contained links to two documents on best practices for working with the agency to develop guidance documents for regional, industry or commodity specific food safety programs.

A case study and one such guidance document was the Food Safety Guidelines for Cantaloupes. In March 2013, Western Growers facilitated the development of this guidance document to convey the best practices for minimizing potential contamination during the growing, harvesting, packing, cooling, storage and transport of fresh, uncut cantaloupes and netted melons. The U.S. Food and Drug Administration provided technical advice and linked to the guidance document on www.fda.gov, and the guidance has been widely used by produce organizations.

The 5 Steps and Case Study documents that were published by FDA were based on interviews with Western Growers and others who routinely engage FDA in industry developed programs and guidance. 

The FDA’s Center for Food Safety and Applied Nutrition program also develops documents that outline how best to comply with laws and regulations governing food, feed and other FDA-regulated products, and in many cases, these documents are based on existing documents previously developed by industry associations, such as Western Growers.

The FDA website currently links to seven industry guidance documents developed in collaboration with FDA. Western Growers and its members led in the development of five of the seven. You can read the guidance documents here.

WG Center for Innovation Hosts Israel AgTech Innovation Showcase

In an effort to connect agtech innovation centers in Israel with those in California, a delegation of Israel companies will be hosting the “Israel AgTech Innovation Showcase” at the Western Growers Center for Innovation & Technology in Salinas on Wednesday, March 8, 2017. The event will feature a series of events that aim to foster collaboration between farmers, scientists, engineers, entrepreneurs and investors to develop more productive, integrated and less wasteful food systems.

Dennis Donohue, lead of the WG Center for Innovation & Technology, will be heading the “Salinas as a Global AgTech Hub” panel at 9:00am PST. The March 8 event is one of four events that will be hosted throughout California and Missouri as part of the Showcase.

Repeal and Replace: Health Benefits Updates

On January 20, President Trump signed an executive order regarding the Affordable Care Act (ACA), creating a broad policy statement about how the leaders of ACA-related agencies are to conduct themselves.

While executive orders may not be used to modify laws or regulations, Trump’s order did include directions to:

  • Avoid cost burdens on states, individuals, families, doctors, insurers, and patients.
  • Cooperate with states to implement alternative healthcare programs.
  • Encourage the development of a free and open healthcare services and insurance market, with the goal of maximizing options for consumers.
  • Comply with the Administrative Procedure Act and other laws while enacting these regulatory revisions.

The executive order is not expected to immediately affect companies’ health care benefits. Since the order lacks a concrete action plan, nothing will happen until the agencies’ leadership develops a strategy to implement the order, an IRS commissioner is put in place, and the heads of the effected departments (including Health and Human Services, Treasury, and Labor) are confirmed by Congress.

Nassif Analyzes Trumps First 100 Days in Blog Series

During President Donald Trump’s first 100 days in office, Western Growers President and CEO Tom Nassif will be providing an in-depth analysis on how proposed federal policies will affect agriculture. The blog series kicks off today with an analysis on what Trump’s executive order concerning the Affordable Care Act (ACA) means for farmers.

“You may be asking ‘what effect does the ACA Executive Order have on my health care benefits and business?’ As of right now, not much. This executive order doesn’t modify existing law or regulation; it just merely demonstrates the President’s ultimate intention: to repeal and replace the ACA,” said Nassif in his blog entry.

Repeal and Replace: Health Benefits Timeline Update

President Trump’s Affordable Care Act (ACA) executive order may not affect your health benefits in the short term, but his promise to repeal and replace the ACA makes it likely that major changes are on their way.

Once the Trump administration assembles its team, the new republican Congress can use a majority vote to unilaterally pass budget reconciliation legislation, effectively crippling the existing system by repealing the employer and individual mandates, individual subsidies at the health insurance exchanges, the expansion of Medicaid and ACA-related taxes.

Please know that any new legislation would require corresponding regulations that would need to be drafted, subjected to comment, and finalized. These additional steps could delay any substantive changes to employer health benefit plans by several more months.

1095-B and 1095-C Reporting Deadline Approaching

February 16th, 2017

The due date for furnishing the 2016 Form 1095-B, Health Coverage, and the 2016 Form 1095-C, Employer-Provided Health Insurance Offer and Coverage, is March 2, 2017. The IRS issued a notice late last year granting an extension of the 1095-B and 1095-C reporting from January 31, 2017, to March 2, 2017.

Following consultation with stakeholders, the Department of the Treasury and the IRS have determined that a substantial number of employers, insurers and other providers of minimum essential coverage need additional time beyond the January 31, 2017, due date to gather and analyze the information and prepare the 2016 Forms 1095-B and 1095-C to be furnished to individuals.

The extension applies to insurers, self-insuring employers, and certain other providers of minimum essential coverage under section 6055 of the Internal Revenue Code and to applicable large employers under section 6056 of the Code. This notice also extends good faith transition relief from section 6721 and 6722 penalties to the 2016 information reporting requirements under sections 6055 and 6056.

This extension does not apply to the filing of information returns to the IRS and the deadline for filing paper returns remains February 28, 2017, while the electronic filing deadline is March 31, 2017.

DPR Issues Emergency Applications of Fungicides to Orchards

The California Department of Pesticide Regulation (DPR) recently issued a letter to counties throughout Northern California that there is a need for emergency aerial applications of fungicides to orchards with standing water. Counties affected include Butte, Colusa, Glenn, Merced, San Joaquin, Stanislaus, Sutter, Tehama, Yolo and Yuba.

DPR notes that the unusual wet weather throughout the Sacramento Valley has made ground applications difficult and significant economic crop losses are expected if these aerial applications are not made. DPR is authorizing the emergency application of several fungicides to orchards with standing water only. The order will be in effect until June 1, 2017.

Products containing one or more of the following fungicide active ingredients may be applied to orchards with standing water: alumino tris (o-ethyl phosphonate), azoxystrobin, calcium polysulfide, captan, chlorothalonil, copper, copper oxychloride, copper hydroxide, cyprodinil, difenoconazole, iprodione, fenbuconazole, fenhexamid, fluopyram, mancozeb, metalaxyl, myclobutanil, propiconazole, pyrimethanil, tebuconazole, thiophanate-methyl, trifloxystrobin and the combination of boscalid and pyraclostrobin (trade name Pristine) and the combination of pyraclostrobin and fluxapyroxad (trade name Merivon). The key issue to be aware of when considering these applications is that any of the standing water cannot be pumped offsite, or flow offsite due to run-off.

The conditions for application are:

  1. Water must be standing and will not flow into state waterways where fish and wildlife are likely to be affected. Applications are not allowed if water is flowing off the intended application site.
  2. Standing water will not be pumped from the orchard after the fungicide application.
  3. Applications are made in accordance with all other label directions.

Additionally, you cannot do an application if:

  1. Soil moisture is at field capacity and a storm event, forecasted by the NOAA or NWS, is to occur within 48 hours following the application, or
  2. A storm event that is likely to produce runoff is forecasted to occur within 48 hours following the application.

It is advisable that you read the full order and contact your county ag commissioner prior to any emergency application of fungicides.

WGAT Cedar Health and Wellness Center Now in Oxnard

WGAT recently opened its newest Cedar Health and Wellness Center in the Oxnard area at 650 Hobson Way, Suite 207 in Oxnard.

WGAT participants in Oxnard and surrounding communities can use the new Cedar center, which offers expanded hours, same day appointments, bilingual care and exceptional care options with lower copays than standard health plans. The services include immunizations, preventive routine checkups, health screenings, first aid and pediatric care for children two years and older. To make an appointment, please call (805) 240-2213.

WGAT participants in the Oxnard area who are also covered on the Cedar Plan Network, will be receiving an updated Designated Primary Care Provider listing in the mail, which now includes the Oxnard Cedar Center. Cedar plan participants need to be aware that some of the primary care clinics and providers they have been using as a Designated Primary Care Provider might not be included in the updated listing. These providers are still part of the WGAT provider network but they will have a higher copay of $25 instead of the $5 copay. The effective date of the price structure change is May 1, 2017.

Nassif Details ACA Repeal and Replace Impacts in Latest Blog

Sac Bee Publishes Op-Ed by Nassif, Radanovich and Nelsen on ALRB Appointment of Hall

Western Growers President and CEO Tom Nassif teamed up with George Radanovich, president of the California Fresh Fruit Association, and Joel Nelsen, president of California Citrus Mutual, to pen a Sacramento Bee op-ed (appeared Thursday online, will appear Friday in print) criticizing the Brown administration for its recent appointment of former state Senator Isadore Hall, a staunch UFW ally, to the Agricultural Labor Relations Board (ALRB).

In the op-ed, the authors state that while the ALRB was formed to provide balanced representation between labor and agriculture, it has instead “become one of the most contentious, lopsided administrative boards ever assembled by the state of California.” The authors go on to argue that farmers deserve a fairer, more balanced board.
