2017 California Legislative Update

The California Legislature closed out the legislative year on September 15, 2017, and will not be returning to Sacramento until January 3, 2018. All attention is now on Governor Brown who has until October 15 to sign or veto the bills that have made it to his desk. It is important to note that the bills that did not pass out of the Legislature this year have become two-year bills and have the opportunity to be pursued next year.

Provided below is some of the key bills that Western Growers (WG) has been lobbying on behalf of our members:

AB 5 (Gonzalez Fletcher) WG Oppose: This bill would create the Opportunity to Work Act and would require an employer with 10 or more employees to offer additional hours of work to an existing nonexempt employee before hiring an additional employee or subcontractor. The bill was held in the Assembly and is now a two-year bill.

AB 168 (Eggman) WG Oppose:  This bill would prohibit an employer from seeking salary history from a job applicant. Employers would also not be able to rely on salary history as a factor in determining whether or not to extend a job offer to an applicant or what salary should be offered to the applicant. The bill was passed and WG is requesting that it be vetoed.

AB 450 (Chiu) WG Neutral: This bill would impose various requirements on public and private employers with regard to federal immigration agency worksite enforcement actions. The bill would prohibit an employer from providing a federal immigration enforcement agent with access to a place of labor without a judicial warrant. It would also prohibit an employer from providing voluntary access to a federal government immigration enforcement agent to the employer’s employee records without a subpoena. Late amendments to the bill allowed WG to remove opposition. The bill was passed and is awaiting approval or veto by the Governor.

AB 1209 (Gonzalez Fletcher) WG Oppose:  This bill would require California employers with 500 or more employees to collect gender wage differentials of their exempt employees and board members. This information would be provided to the California Secretary of State who would then post the company specific information on its website. The bill was passed and WG is requesting that it be vetoed.

AB 1565 (Thurmond) WG Oppose: This bill would exempt an executive, administrative or professional employee from overtime compensation if the employee earns a monthly salary equivalent to either $3,956 or an amount no less than twice the state minimum wage for full-time employment—whichever amount is higher. AB 1565 was held in the Senate and is now a two-year bill.

SB 100 (De Leon) WG Oppose: This bill would establish the 100 Percent Clean Energy Act of 2017, which would increase the Renewables Portfolio Standard (RPS) requirement from 50 percent to 60 percent by 2030. The bill also creates a policy goal of having all of the state’s retail electricity be generated with 100 percent clean energy by 2045. This bill was held in the Assembly and is now a two-year bill.

SB 772 (Leyva) WG Oppose: This bill would exempt Cal/OSHA from conducting a Standardized Regulatory Impact Assessment, which is an assessment that is required of all state agencies when they are developing a regulation that will have an annual economic impact of $50 million or more. SB 772 would reduce accountability and transparency in government. This bill was held in the Assembly and is now a two-year bill.

Almond Alliance Signs MOU with Western Growers to Expand Insurance Services

Western Growers Insurance Services has developed a strategic partnership with the Almond Alliance of California to advance the breadth of health benefits and insurance services available to members of the Alliance.

On September 27, 2017, WGIS and the Alliance entered into a Memorandum of Understanding to provide proprietary insurance programs and full-service risk management solutions to Alliance members including almond processors, huller/shellers and growers. Under the partnership agreement, the Alliance will endorse and promote WGIS as a preferred insurance broker for all lines of insurance.

Members of the Almond Alliance who enroll in any of the WG’s insurance solutions will receive comprehensive consultation to assist in the prevention of recalls, mitigate exposure and expertly navigate through any recall-related event.

CDPR Releases Proposed Chlorpyrifos Mitigation Measures

On Tuesday, the California Department of Pesticide Regulation (CDPR) posted their Evaluation and Options for Interim Mitigation Measures to Reduce Acute Chlorpyrifos Exposure to Bystanders. Western Growers believes that the proposed mitigation measures are overly conservative and unnecessary.

The mitigation measures are based on a model that has not been validated for predicting exposure and is based on unrealistic conditions and use patterns. In fact, in the memo released Tuesday, CDPR states, “the August 2017 risk assessment includes several uncertainties or assumptions that potentially overestimate the risk and lead to more stringent mitigation measures than needed to meet the regulatory target.” 

Comments on the most recent risk assessment closed concurrent with the release of the proposed mitigation measures – which demonstrates that CDPR developed mitigation measures without consideration of public commentary on the risk assessment.

Chlorpyrifos is perhaps the most widely studied insecticide in the world and is used on numerous specialty crops, including tree nuts, vegetables, grapes and citrus. Western Growers continues to call on CDPR to use real world scenarios and assumptions, appropriate models, and all relevant studies in the continued review of chlorpyrifos so that final decisions are based on sound science and understood by the agricultural industry.

Tech Talk Reveals Innovative Technology that Forecasts Yields

AgriData, one of 48 agtech startups housed in the WG Center for Innovation & Technology, provides yield estimation and management technology with unmatched accuracy for farmers of permanent crops.

During the Tech Talk, Habis will explain how the data and imagery collected from cameras mounted on a farm’s ground vehicles enables variable rate farming and significant business optimizations. AgriData guarantees that their technology will allow growers to do the following:

New Insurance Options for H-2A Users Now Available

Responding to the significant increase in H-2A usage throughout the agricultural industry, Western Growers has created new insurance options for employers who use the temporary ag labor program. The new insurance solution covers risks specifically associated with the use of the H-2A temporary ag program.

Tailored Recall Insurance Solution Protects Against Hep A Outbreaks

A recent hepatitis A outbreak claimed nearly 20 lives in California. Western Growers wants to assure members that there are insurance solutions that can protect food and ag-related businesses when a contamination event occurs. Six AgTech Startups Selected to Compete in AgSharks for Funding, Farmland

Western Growers and S2G Ventures have selected the six agtech start-up companies who will be competing in AgSharks™ for equity investments totaling up to $250,000 to support the development and growth of their businesses, as well as for acreage to pilot their technologies.

The following are the companies selected to compete in the AgSharks event:

Western Growers Addresses AG Act Concerns with Bill Sponsor and House Leadership

This week, the House Judiciary Committee held a two-day mark-up of Chairman Bob Goodlatte’s “The AG Act” (H.R. 4092). Yesterday, the Committee passed the legislation by a vote of 17-16. Two Republicans joined Democrats in voting against the bill, and seven members (four Republicans and three Democrats) were absent for the final vote.

The proposed legislation would replace the current H-2A visa program with a new H-2C visa program and contains several key agriculture workforce components, including a handful of positive ones. Unfortunately, H.R. 4092 also contains several unworkable components that need to be addressed for it to have our full support. 

Following the vote, Western Growers President and CEO Tom Nassif issued a media statement and also sent an email to members regarding the bill. Though WG supported its passage from the committee as a first step to addressing our critical labor needs, both the media statement and the email to members reiterated our strong opposition to the negative components of the bill that include:

  • lowering the cap on visas;
  • eliminating the work authorization period for the current workforce;
  • allowing Ag to access the green card system in the future; and
  • a ‘touchback’ provision for workers before they are eligible for the H-2C program.

Additionally, the Committee adopted an amendment that would require mandatory E-Verify legislation also be signed into law before the AG Act could be enacted, which makes it even more critical that we get the ag solution right.

Western Growers has also clearly expressed to Chairman Goodlatte, House Leadership and House members our concerns about the legislation and will continue to work with them to seek the necessary changes to make this bill a workable solution for our members.

DOT Issues Exemption to Regulation Prohibiting the Transportation of Pre-1991 Mobile Refrigeration Units

Western Growers and other industry members have been working with the International Institute of Ammonia Refrigeration to secure regulatory relief from the U.S. Department of Transportation (DOT) preventing the continued transportation of pre-June 1, 1991, mobile refrigeration units.

For those members involved in the transportation of mobile refrigeration units, the following action taken by the DOT will allow the continued use of equipment that has been in service prior to June 1, 1991. 

DOTs exemption notice states: Until a final determination is made, the Pipeline and Hazardous Materials Safety Administration (PHMSA) will not take enforcement action against a person who continues to use refrigeration units placed into service prior to June 1, 1991, if all portions of the system have a design pressure of 250 psig and are otherwise in compliance with the ASME Code and provision of §173.5b.

Nassif to Participate in October 5 Immigration Policy Event

On Thursday, October 5, 2017, Western Growers President and CEO Tom Nassif will participate in the National Immigration Forum’s event, Leading the Way: A New Approach to American Immigration in Washington, D.C. The event will bring together faith, law enforcement, business leaders and others for a constructive conversation on immigration policy solutions that serve the interests of America, especially its workers and their families. Western Growers is sponsoring the event.

The all–day event will feature four panel discussions and a keynote luncheon address from Senator Thom Tillis (R-NC). Nassif will participate in the Growing American Jobs through a Balanced System panel from 11:15 a.m. – 12:15 p.m. The panel will explore the role immigrants play in growing the American economy and related issues.

Also participating on the panel will be: Tim Brown, president & chief operating officer, Chobani; Rosanna Maietta, senior vice president of communications & public relations, The American Hotel & Lodging Association; and Kathleen McLaughlin, senior vice president and chief sustainability officer; president, Walmart Foundation. Vice President & Senior Economist, Federal Reserve Bank of Dallas, Pia M. Orrenius will moderate the discussion.

The three other panels will focus on security and the border, welcoming immigrants and refugees during times of conflict, and how to address America’s cultural and economic anxiety as the conversation moves forward.

Nassif Discusses Ag Immigration Policy during National Immigration Forum Event

Today, Western Growers President & CEO Tom Nassif joined leaders from Chobani, Walmart and The American Hotel & Lodging Association on a panel to discuss immigration policy solutions that serve the interests of America, especially its workers and their families.

The event, Leading the Way: A New Approach to American Immigration, was hosted by National Immigration Forum and brought together faith, law enforcement, business pioneers and others for a constructive conversation on immigration.  

The all–day event featured four panel discussions and a keynote luncheon address from Senator Thom Tillis (R-NC). Brown Vetoes WG-Supported Fair Water Rights Hearing Bill

In the final hours to sign or veto bills sent to him by the California Legislature, Governor Brown vetoed AB 313 by Assemblymember Adam Gray, a Western Growers-supported bill that would have inserted much-needed balance into the state’s water rights enforcement activities.

The current system gives the State Water Resources Control Board (Water Board) authority to not only allocate water rights and permits, but to unilaterally enforce these rights and mete out punishment if they believe there has been a violation by a water user.

These decisions are made in water rights enforcement hearings, which are conducted by appointed Water Board members using their own staff as investigators and prosecutors, with the board members themselves acting as judge and jury.

In a press release, Assemblyman Gray expressed frustration and disappointment with the governor’s veto, saying: “For more than half a century, the State Water Resources Control Board has kept a dirty little secret. They are the judge, the jury, and the prosecution in the water world. They have zero accountability to the people of California, yet their decisions impact the daily lives of millions of people.”

Clearly, the current system creates challenges for the Water Board to provide fair hearings and appropriate judicial review.

In an effort to ensure fundamental fairness in these proceedings, AB 313 would have transferred the responsibility of conducting water rights enforcement hearings to a new Water Rights Division in the Office of Administrative Hearings.

In his veto message, the governor said: “While I acknowledge the author’s intent to increase fairness and transparency in enforcement actions taken by the Board, the bill would not work as intended.”

However, in his veto message, Governor Brown did direct the Secretary of the Environmental Protection Agency to evaluate the role for administrative law judges and provide a recommendation on improvements to the Water Board’s hearing process by January 1st, 2018.

Former WG Board Member David Hart Passes Away

October 19th, 2017

Following a long illness, David Hart, former Western Growers’ Board Director and respected agriculture industry leader, passed away on Tuesday, October 17, 2017.

According to Grower-Shipper Association’s Jim Bogart, Dave served twice on GSA’s board during the 40 years he spent in agriculture. He also held prominent positions at Royal Packing, Dole Fresh Vegetables and, most recently, Church Brothers.

Sr. Executive Vice President Matt McInerney said, “David was a very dedicated board member, giving of his time and expertise to so many Western Growers’ efforts. His contributions to the produce industry are immeasurable. He will be sorely missed. Our deepest condolences go out to his wife Mary, his children Tracy and Heather, and his father Don who also served as a Western Growers’ board member.”

No information about a memorial service was available at the time of publication. 

House Judiciary Holds Ag Labor Mark-up with E-Verify Consideration Coming Tomorrow

Today, the House Judiciary Committee began a mark-up of H.R. 4092 “The AG Act” (Rep. Bob Goodlatte). This is the first step in the legislative process as the House begins consideration of immigration legislation. The mark-up of the AG Act has recessed for today and will continue tomorrow with consideration of the Legal Workforce Act (Rep. Lamar Smith) to follow. 

Today’s mark-up came three weeks after an earlier mark-up of the legislation had to be postponed because of opposition from all Democrat members of the committee, and several Republican members who were concerned that the legislation would be providing “amnesty” for current unauthorized farmworkers. There were also concerns that the visa cap was too high and could therefore result in displacement of American workers. The committee made several changes to the previous version of the bill in an attempt to garner the support of Republican members who opposed.   

The AG Act contains several key components:

  • Agency Administration: USDA enforces and administers H-2C and the program will begin six months after enactment. H-2A will sunset at that time.
  • Housing: There is no requirement that employers provide housing or transportation.
  • Visa Cap: There is an annual visa cap of 450,000 (with a sub cap of 40,000 within the processing sector). The cap does allow for increases (or reductions) if cap is (or is not) reached. Unauthorized ag workers at the time of introduction who become H-2C workers will not count against the cap.
  • Type of Employment: H-2C is a contractual employment, however ‘at-will’ employment is available with a “Registered Agricultural Employer” only if they have completed their contractual employment and have eligible time remaining on their visa.
  • Visa Term: If temporary or seasonal, an initial visa period up to 18 months of continuous stay. For non-temporary work, initial visa period up to 36 months continuous stay, subsequent visas are 18 months. H-2C workers must remain outside the U.S. for 1/12 of prior visa term or 45 days before renewing.
  • Wages: State or local minimum wage or 15 percent (50 percent for processing workers) above Federal minimum wage, whichever is greater.
  • Current Workforce: Must enter H-2C program, and within 6 months of being granted H-2C status, the worker must depart and remain outside of the U.S. for a yet to be defined period, and then make continued subsequent departures amounting to 1/12th of their visa term. Prior to H-2C becoming operational, an existing unauthorized worker would have no protected status. Additionally, family members of H-2C workers would receive no legal status.
  • Mandatory E-Verify: For workers in agriculture, would go into effect 18 months after enactment.

While there are a handful of positive components in this legislation, we will continue to advocate that our current workforce needs to be allowed to remain working in agriculture without disruptive requirements that could force them out of the country. We also strongly oppose a visa cap for future workers. Such a policy only serves to limit the future economic growth potential of the agriculture sector.

It is important to note that the legislative process is rarely a straight line from introduction to a bill becoming law. There will be many challenges and opportunities during this process. We will need to continue to advocate that producer-friendly provisions are maintained, and we will need to work through the process to see remaining concerns about the current and future agricultural workforce addressed.

Additionally, we will need all coalition partners to be engaged at every step of the process, from completion of committee action, to the House floor, through Senate action and conference. We should not assume that provisions we need added or improved will be addressed by the Senate, so we need to concentrate on getting the best possible product out of the House. We look forward to continuing our work with Chairman Goodlatte, Leadership, every other member of the House, and then the Senate, to get the best possible legislative product.

Almond Alliance Partners with Western Growers to Expand Insurance Services

Almond Alliance Signs MOU with Western Growers on Health Benefits, Insurance Services

Modesto, Calif. (October 2, 2017) – The Almond Alliance of California, an association dedicated to ensuring the sustainability and success of the California almond community, has developed a strategic alliance with Western Growers Insurance Services Inc. (WGIS) to advance the breadth of health benefits and insurance services available to members of the Alliance. On September 27th, the Alliance and WGIS entered into a Memorandum of Understanding to provide proprietary insurance programs and full-service risk management solutions to its members including almond processors, huller/shellers and growers. Under the partnership agreement, the Almond Alliance will endorse and promote WGIS as a preferred insurance broker for all lines of insurance.

“We represent over 80 percent of the almonds processed in California, and this new strategic alliance with Western Growers Insurance Services will be crucial in helping advance our mission of enabling the almond community to conduct their businesses as efficiently as possible,” said Kelly Covello, president of the Almond Alliance of California.

Backed by WGIS’ access to global markets, WG’s insurance programs leverage a proprietary approach unique to agriculture and builds an insurance solution that is fully customizable and tailored to each individual organization. The partnership agreement stipulates that now all Almond Alliance members will be offered WG’s insurance programs such as tailored insurance solutions, employee health benefits, general liability, crop insurance, workers compensation and more.

Western Growers Rolls Out New Insurance Solution for H-2A Users

Responding to industry need, WG develops coverage tailored to H-2A Temporary Ag Labor Program

IRVINE, Calif. (October 17, 2017) – Responding to the significant increase in H-2A usage throughout the agricultural industry, Western Growers has created new insurance options for employers who use the temporary ag labor program. The H-2A temporary ag program allows agricultural employers who anticipate a shortage of domestic workers to bring nonimmigrant foreign workers into the United States for temporary or seasonal agricultural work. The new insurance solution covers risks specifically associated with the use of the H-2A program.

“Western Growers is one of the few organizations who offers a tailored insurance solution that reduces exposure to losses that can result from utilizing the H-2A program,” said Jeff Gullickson, senior vice president of Western Growers Insurance Services, the wholly-owned insurance brokerage of Western Growers. “After noticing a rapid increase in H-2A use and a lack of insurance packages that cover potential program exposures, we combined our expertise in H-2A and workers’ compensation to offer this niche product.”

The U.S. Department of Labor recently reported that there has been a 15 percent increase in the number of H-2A applications received, compared to the same time last year. In California alone, the number of jobs certified rose from 2,600 in 2006 to over 11,000 in 2016. The number of certified positions in 2017 is expected to top 15,000.

For the past decade, Western Growers (WG) has offered farming operations assistance and step-by-step consultation in obtaining a workforce through the H-2A program. WG representatives fully understand all the risks involved in utilizing the H-2A program, as they are continually advising members on how to stay compliant with H-2A regulations such as providing transportation, housing and meals for their workers.
