Western Growers, Industry Allies Urge Federal Action on Export Crisis at West Coast Ports

This week, Western Growers and nearly 300 allied agriculture and forest products companies and associations sent a letter to Secretary of Transportation Pete Buttigieg, urging his immediate intervention to support U.S. exporters and ensure their access to overseas markets.

Since fall of 2020, U.S. agricultural exporters have faced extreme challenges getting their products onto ships and out to foreign buyers, including record-breaking congestion and delays at ports, carriers’ persistent failure to provide accurate notice of arrival/departure and cargo loading times, excessive imposition of financial penalties and other fees, and skyrocketing freight rate costs. The group letter urges the Department of Transportation to consider its existing powers and determine how it can assist with the transportation needs of U.S. ag exporters in overcoming the current challenges in shipping goods and products.

Foreign markets are critical to Western Growers members, and we have been proactively monitoring the ongoing situation and elevating the issue with the state and federal governments. We continue to press for action from the Administration, as well as Congress, to engage the marine transport supply chain – particularly the shipping lines and terminals – to find solutions and relief.

Walmart’s OTIF Policy – Shipper Feedback Request

Fresh produce shippers are used to dealing with unique retailer demands getting their product to market. One such challenge, first introduced by Walmart U.S. in 2017, is the retail giant’s on-time in-full (OTIF) policy. As the name indicates, this logistics compliance program requires product to arrive at Walmart’s distribution centers on time and in full. Shipments that arrive early, late, short, or not otherwise as specified in the Purchase Order, are all subject to fines. 

While OTIF has been in place for several years, Walmart recently modified its targets, making compliance even more difficult, if not downright impossible. In effect since September 15, 2020, shippers that fall below the newly raised 98% on-time in-full target are subject to an automatic 3% total cost of goods fine. Put simply, 98% of all supplier deliveries must arrive on their Must Arrive By Date and must contain 98% of the cartons ordered, or penalties will be enforced. 

One of the key concerns is that if a shipper scores less than 98% OTIF on orders during a given period, Walmart will take deductions on all orders during that period, potentially affecting a shipper’s entire program. This can be problematic since, according to a McKinsey & Company report, nine out of ten “late” shipments are set to fail even before the load is picked up.

Western Growers Teams with Organic Produce Network to Present Organic Grower Summit 2021

To emphasize the importance of organic production, Western Growers (WG) and the Organic Produce Network (OPN) have formed a strategic partnership, and this week announced that Western Growers will be the presenting sponsor of the Organic Grower Summit 2021.

“Many Western Growers members are heavily invested in organic production, and many others are considering a move into organic production for the first time,” said Dave Puglia, president and CEO of Western Growers in the official OPN press release. “The Organic Grower Summit is a great opportunity for growers in either position to get the latest in innovation and industry trends that are impacting the organic segment for fresh produce.”

Comment Period to Revise LGMA-Approved Guidelines Now Open

Western Growers invites all stakeholders interested in enhancing the safety of leafy greens to engage in the amendment process for food safety guidelines that impact the way leafy greens are farmed in California and Arizona.

Since the inception of the California and Arizona Leafy Green Marketing Agreements (LGMAs), Western Growers (WG) has been at the forefront of developing and revising the written “Commodity Specific Food Safety Guidelines for the Production and Harvest of Lettuce and Leafy Greens” for the leafy greens industry in both states.

On March 29, 2021, the comment period for issues related to Soil Amendments and Non-Synthetic Crop Treatments (Issues # 7 and # 8 in the guidelines) opened until April 27, 2021. To propose a revision to the guidelines, click on the button below.

PROPOSE A CHANGE

The Process

To facilitate this process, ensure broad industry engagement and transparency, WG, in partnership with the Arizona and California LGMAs, manages a systematic amendment process based on a yearly calendar. The food safety guidelines, adopted by the LGMAs, impact the way leafy greens are farmed in California and Arizona and therefore must be based on credible science balanced with practical field implementation.

Proposed changes must meet LGMA criteria to be considered. Proposals should be 1) comprehensive, 2) accompanied by a statement on how proposed changes will enhance food safety, and 3) include a clear and straightforward scientific basis or rationale, including citations of relevant research if available.

WG invites all stakeholders interested in enhancing the safety of leafy greens to engage in this process.

FDA Releases E.coli Outbreak Investigative Report, Leafy Greens STEC Action Plan

On April 6, 2021, the U.S. Food & Drug Administration (FDA) released two important documents for leafy green operations.  

The first is an investigative report on the fall 2020 outbreak of E. coli O157:H7 illnesses linked to leafy greens’ consumption. In the report, the FDA analyzes outbreaks since 2017 and identifies three key trends leading to the contamination of leafy greens by E. coli O157:H7 in recent years. The second document is an updated version of the Leafy Greens Shiga toxin-producing E. coli (STEC) Action Plan, building on the work accomplished in 2020. The updated Leafy Greens Action Plan emphasizes actions to prevent contamination from activities on adjacent land, new actions that build on the accomplishments, and learnings from the 2020 plan. WG Forms Food Safety Advisory Subcommittee

Western Growers has formed a new Food Safety Advisory Subcommittee (FSAS) to bolster its efforts in solving produce safety challenges.

FSAS members will advise the Food Safety Science and Technology Committee, which reports to the WG’s Board of Directors, while providing technical expertise and advice on science issues and industry regulations affecting the safety of fresh produce. Members of FSAS will be abreast of WG’s key food safety efforts and projects and have the opportunity to provide WG’s Science staff with feedback on these endeavors.

Sign Up Today for CFAP 2 Payments for COVID-19 Losses

USDA has reopened signups for the Coronavirus Food Assistance Program 2 (CFAP 2) as of April 5, 2021. As part of the Pandemic Assistance for Producers initiative, farmers and ranchers will have at least 60 days to apply or make modifications to existing CFAP 2 applications.  

CFAP 2 provides financial assistance that gives producers the ability to absorb increased marketing costs associated with the COVID-19 pandemic. Among the eligible commodities are specialty crops and nursery crops. The initial CFAP 2 signup ended on Dec. 11, 2020.

The payments will go out under the existing CFAP rules with a handful of tweaks. Specifically, USDA will make it easier for farmers and ranchers to file for CFAP. USDA will pull in different data sets than last year, such as now factoring in federal crop insurance payments as part of the sales data against which producers can claim.

 Visit farmers.gov/cfap for details on all eligible commodities, producer eligibility, payment limitations and structure and additional program resources.

Producers have multiple options to apply for CFAP 2, including through an online application portal and by working directly with the FSA office at their local USDA Service Center. Customers seeking one-on-one support with the CFAP 2 application process can call 877-508-8364 to speak directly with a USDA employee ready to offer assistance. This is a recommended first step before a producer engages with the team at the FSA county office.

Arizona Anticipates Colorado River Shortage

April 20th, 2021

On Friday, April 2, 2021, the Arizona Department of Water Resources and the Central Arizona Project released a joint statement on the presumption of a “Tier 1” shortage declaration on the Colorado River.

A “Tier 1” shortage declared on the river will result in an additional 320,000 acre-feet cut, for a total of 520,000 acre-feet reduction per year starting in 2022. These expanded cuts will impact agriculture operations in central Arizona, namely Pinal County, the hardest. Delivery of Colorado River water will be reduced by nearly 50% in 2022, then terminated in 2023 and thereafter.

DIR Launches Web-based COVID-19 Supplemental Paid Sick Leave Tool

The Department of Industrial Relations and its California Labor Commissioner’s Office recently launched a web-based tool that offers key information on the new 2021 COVID-19 Supplemental Paid Sick Leave law. The web tool is available here: https://www.dir.ca.gov/dlse/covid-psl/

This tool is available in both English and Spanish and provides employers and their workers easy access to information on workers’ paid sick leave options. Through the web tool, workers and employers can confirm if they are eligible for COVID-19 supplemental paid sick leave by answering short simple questions on the impact COVID-19 is having on an employee’s ability to work.

The new law applies to employers in the state of California with more than 25 employees and California employees who are not able to work or telework for any of seven reasons detailed in the legislation. The leave time now also applies to attending a COVID-19 vaccine appointment and recovering from symptoms related to the vaccine, among other reasons. Eligible employees are entitled to up to 80 hours of supplemental paid sick leave. The law, which is retroactive to January 1, 2021, is in effect until September 30, 2021. Western Growers Launches Global Harvest Automation Initiative

Groundbreaking initiative aims to accelerate ag automation by 50 percent in 10 years

IRVINE, Calif. (April 15, 2021) – Western Growers (WG) is spearheading a Global Harvest Automation Initiative (GHAI) to accelerate harvest automation across the fresh produce industry, with a goal of automating 50 percent of harvest within 10 years.

“For well over a decade, our members have struggled with a dwindling number of available workers. If we don’t come together as an industry to quickly and efficiently deliver automation solutions for farmers in this country, it is likely that the shift of fresh produce operations to other countries will dramatically increase,” said Western Growers President and CEO Dave Puglia. “The Global Harvest Automation Initiative is aimed directly at this challenge, and the alignment of so many industry leaders and partners in this endeavor is a strong indicator of our shared commitment to success.”

The global initiative is comprised of several key projects uniquely designed to solve the ag industry’s labor woes while simultaneously helping harvest automation start-up companies commercialize and scale at a more rapid pace:

  • Technology Stack: A documented set of technical interfaces that will help startups leverage industry-standard components so their robots can get into fields and markets faster.
  • Harvest Automation Cohort: A cohort of automation startups will be selected based on industry input to receive exclusive access to systems integration to help integrate the tech stack into their product roadmap, strategy for go-to-market support, field trials and case studies.
  • Impact Report: A comprehensive analysis on the impact of harvest automation on the specialty crop industry will be provided annually based on grower metrics.
  • Harvest Automation Traction Roadmap: A list of current harvest automation startups by crop type and in-market progress/traction will be distributed regularly.

The technology stack will be built by a team of subject matter experts (SMEs) in ag and robotics:

  • precision ag companies (Trimble, Bosch)
  • original equipment manufacturers and platform companies (Ramsay Highlander, Oxbow and SPUDNIK)
  • AgTech engineering companies (Milano Technical Group, All-Phase Agricultural Engineering, Red Rooster Engineering and NWFM LLC)
  • WG members that are among the world’s largest and best farming operators at adopting new technologies (Grimmway Farms, Turlock Fruit Company, Church Brothers Farms, Superfresh Growers and Illume Agriculture)

The SME group will build a set of documented interfaces so startups can connect to tractor manufacturers like John Deere, sensor manufacturers like Bosch, navigation equipment providers like Trimble, and other manufacturing partners.

The Washington Tree Fruit Research Commission (WTFRC) has been a key partner for WG in supporting the GHAI by providing recommendations for SMEs and harvest startups with traction based on WTFRC’s 52 years of experience with tree fruit innovation. In addition, WTFRC has committed $200,000 in funding over 3 years to support the overall GHAI initiative.

“The specialty crop industry needs to all work together to solve harvest automation by strategically accelerating the speed of innovation and adoption,” said Dr. Ines Hanrahan, executive director for WTFRC. “The platform approach Western Growers is taking is supported by both startups and industry as the best path forward to finally achieve this goal.”

Alexandra Allen, owner of Main Street Produce and Freshway Farms, has operated her Santa Maria-based businesses alongside her husband since the ’70s. But only in the last few years did they begin to use the H-2A program, which allows foreign agricultural workers to labor in the U.S. on a temporary visa.
