WGCIT Hosts Virtual Session on the Challenges and Rewards of Growing in the Central Valley

The Western Growers Center for Innovation and Technology hosted Turlock Fruit Company General Manager Neill Callis and HMC Farms Vice President Drew Ketelsen to speak about their experience as growers in the Central Valley.

Almost 30 startups attended the event, where the duo shared insights into their growing region and talked about the importance of automation. In particular, they discussed how their operations were open to innovation but with the ongoing labor crisis, the farms remain limited on time and staff to work on integrating new technology.

Early Registration Rate for FREP/WPH Nutrient Management Conference Ends Tomorrow

October 14 is the last day to receive the early registration rate for the 30th FREP/WPH Annual Nutrient Management Conference, which will be held on Oct. 26-27, 2022 in Visalia, Calif.

Students, researchers, and industry members can present their ongoing research, outreach, or demonstration projects in California related to irrigation and nutrient management during the conference; the abstract submission deadline is also October 14th.

Solicitation Now Open for SGMA Implementation Round 2 Grants

The Department of Water Resources announced that the Sustainable Groundwater Management (SGM) Grant Program’s SGMA Implementation Round 2 grant solicitation has officially opened.

Round 2 will provide approximately $230 million for planning and implementation projects to help comply with the Sustainable Groundwater Management Act.

Round 2 is open to applicants located within medium- and high-priority basins, including critically overdrafted groundwater basins. The 2021 SGMA Implementation Guidelines (2021 Guidelines) and Proposal Solicitation Package (PSP) posted in December 2021 can be located on the SGM Grant Program’s website at www.water.ca.gov/sgmgrants and will be used for Round 2.

DOL Publishes Proposed Independent Contractor Rule for Public Comment

The U.S. Department of Labor (DOL) has officially published its newly proposed rule for classifying workers as Independent Contractors (IC) under the Fair Labor Standards Act (FLSA). The newly proposed rule reinstates a multifactor “totality of the circumstances” approach requiring the consideration of various factors – considered as part of the larger economic reality of the worker – in determining whether a worker qualifies as an IC.

The new rule emphasizes that no one factor, or subset of factors will be necessarily dispositive of the IC issue and that the factors listed are not to be considered an exhaustive list. Nonetheless, these factors as a matter of course, generally include the opportunity for profit or loss, investment, permanency, the degree of control by the employer over the worker, whether the work is an integral part of the employer’s business, and skill and initiative.

A seventh “additional factors” catch-all would allow for the consideration of any factor relevant in determining whether the worker is an employee or IC for purposes of the FLSA, if the factor(s) in some way indicate whether the worker is in business for themself, as opposed to being economically dependent on the employer for work.

Published on October 13, 2022, the public comment period will remain open for a period of 45 days. The DOL strongly recommends commenters submit their comments electronically via https://www.regulations.gov to ensure timely receipt prior to the close of the comment period, as the Department continues to experience delays in the receipt of mail.

Judges Selected for AgSharks Pitch Competition

IRVINE, CALIF. (Oct. 14, 2022) – Western Growers and S2G Ventures have announced the judges for the 2022 AgSharks Competition, a unique event where startup companies pitch their innovations in front of a live audience of the world’s largest specialty crop producers to win a $250,000 minimum investment. 

Three startups will be selected to pitch their inventions to these judges in front of an audience of more than 300 fresh produce farmers and industry leaders during the WG Annual Meeting in Las Vegas on Nov. 2-5, 2022. The competition will be hosted by Stuart Woolf, President and CEO of Woolf Farming & Processing.

In addition to potential investment capital, the winner(s) will receive international recognition, mentoring from S2G and WG, potential access to farm acreage to pilot their technologies and access to WG’s expansive network of leading fresh produce companies.

The judges are:

Neill Callis

Neill Callis is the General manager of Turlock Fruit Company, a family-owned and operated fresh produce grower / shipper / packer founded in 1918 by James “Cantaloupe” Smith. Neill joined the company in 2013 following a 17-year career as a project manager and systems engineer in the aerospace industry. As a member of the family management team, he now works alongside the 2nd (Don), 3rd (Steve), and 4th (Alec) generations of the Smith family operating the business of farming honeydews, cantaloupes, mixed melons, asparagus, cherries, tomatoes, and almonds in Merced and Fresno counties.

Neill has served on the California Cantaloupe Advisory Board since 2015, participated in the Western Growers Future Volunteer Leaders program (Class III), and served as an industry mentor to Cohorts II/III of the Thrive AgTech Accelerator. In the Turlock community, he serves as a Trustee of the Legacy Health Endowment, serves on the boards of the Turlock Community Theatre, Prodigal Sons & Daughters, and Little Lights Preschool, and is also a member of the James Irvine Foundation New Leadership Network’s 3rd cohort. Neill graduated with a. B.A. in Political Science from Elon College, and holds a Graduate Certificate in Complex Space Systems from the Stevens Institute of Technology.

Neill joined the Western Growers Board of Directors in 2019, following in the footsteps of Turlock Fruit Company owners Steve Smith and Don Smith. He is currently serving as Treasurer of the Board. He is married to Steve’s daughter Hilary, and they have two young children, Daniel and Elin. 

Audre Kapacinskas

Audre Kapacinskas is a Principal at S2G Ventures where she leads Corporate Development efforts across our focus sectors: food & agriculture, oceans & seafood, energy, and real assets. Audre actively engages corporate, investor, nonprofit and government stakeholders to identify opportunities to accelerate growth and impact of S2G companies. By building relationships with a diverse ecosystem of stakeholders, Audre seeks to apply advanced and emerging technologies at scale to address today’s most pressing challenges in order to realize a more humane and healthy planet.

Aaron Rudberg

Aaron Rudberg is the COO and Managing Director at S2G Ventures. He has worked in the investment business his entire professional career, and brings experience as an entrepreneur and institutional investor. Prior to joining S2G, Aaron spent 10 years at Baird Capital where he was a Partner and Managing Director overseeing the global strategy, investor relations, marketing and business development for the $3.5 billion private equity and venture capital business. Aaron previously spent time at a private equity fund-of-funds and a venture capital firm. Early in Aaron’s career, he was an entrepreneur building a venture-backed software company that was acquired. Aaron received a BA from the University of Illinois at Urbana-Champaign and an MBA from the Kellogg School of Management at Northwestern University. Aaron is a member of the board of The Civic Federation, Adler Planetarium, and was named an Emerging Leader by the Chicago Council of Global Affairs in 2014.

Kristen Smith Eschaya

Kristen Smith Eshaya is the President of Yuma, Ariz.-based JV Smith Cos. JV Smith Cos. began with the formation of Skyview Cooling Company in 1970 by John Smith, Smith Eshaya’s grandfather and Vic Smith’s father.

Smith Eshaya graduated as the valedictorian of her class at Yuma High School in 2003, and then went on to graduate from Colorado College with a Bachelor of Arts in economics and, later, from Northern Arizona University with a Master of Education in human relations. She lived in Texas and California, working in finance and development for the arts, before moving back home to join the family business.

She also has been involved with industry trade associations, having formerly served on the Center for Growing Talent by Produce Marketing Association board of directors, as well as the PMA diversity and inclusion task force.

Smith Eshaya is currently in the Western Growers Future Volunteer Leaders Program, in addition to serving on the Children’s Museum of Yuma County board of directors. Along with her husband, Emil, Smith Eshaya resides in Yuma with their two children.

AgSharks was first held in 2017, and through the competition, past winners Hazel Technologies and Burro have since brought their products from development to market. Hazel Technologies has raised over $87.8 million in funding over six rounds and is advancing the industry with sachets that extend the shelf life of fresh produce by as much as three times. Burro raised a $10.9 million Series A round in September 2021 led by S2G Ventures and Toyota Ventures and continues to help solve farmers’ labor woes with the expansion of its fleet of autonomous robots to farms across the west.

Western Growers’ Hank Giclas to be Honored at 2022 Food Safety Conference

The University of Arizona Food Safety Consortium’s annual 2022 Food Safety Conference will honor and dedicate this year’s conference to the late Hank Giclas, former Senior Vice President, Strategic Planning, Science & Technology at Western Growers, who passed away earlier this year.

Hank served the Western fresh produce industry in various capacities with Western Growers for more than three decades, from 1990 until he retired in 2020.

The Food Safety Consortium and its partners from academia and industry and government agencies will discuss pressing issues in food safety and the industry’s roles in addressing current and future challenges. The conference will kick off with a virtual (Zoom) session on October 26 from 1 p.m. – 5 p.m. On October 27, the conference will continue with an in-person poster and networking session from 2:30 p.m. – 5 p.m.

VofV: Global Competition Requires Urgent Supply Chain Tech Innovation

On this week’s Voices of the Valley podcast, Dennis Donohue and Candace Wilson interview Gary Loh, the CEO of DiMuto and the Executive Chairman of First Alverstone Group, and Claire Pribula, the Managing Director and Co-Founder of Yield Lab Asia Pacific.

Gary and Claire discuss the changes in the marketplace that have resulted in an urgent need for supply chain innovation. The DiMuto AgriFood trade solution was developed in response to these pressures to help growers, exporters, and importers trade with better visibility and easier tracking of finances. Yield Lab Asia Pacific invested in DiMuto to help farmers “do more with less” and adapt to a growing population and increasing environmental stresses.

2022 Global Harvest Automation Report Survey Now Open to Growers, Start-Ups

The second year of data collection for Western Growers’ Global Harvest Automation Report is underway, and we need growers and start-ups to fill out surveys to help the industry confront the ongoing threat from chronic labor shortages.

Western Growers’ Global Harvest Automation Initiative (GHAI) aims to automate 50 percent of the fresh produce harvest within 10 years through a series of projects involving growers, automation start-ups and key industry players.

To accomplish this, we need the input from both growers and start-ups to help us establish data trends on the current impact of automation in the fresh produce industry. This data will be valuable in attracting additional innovation, talent and funding to the harvest automation space and will be compiled early next year into the second Global Harvest Automation Report.

The initial report, prepared in collaboration with consultants at Roland Berger, found that:

  • 65 percent of participating growers have invested in automation over the past three years
  • The average annual spend on automation was $350,000-$400,000 per grower
  • Spending occurred in pre-harvest and harvest assist activities, including weeding, thinning, harvesting platforms and autonomous ground vehicles. It is anticipated that 30-60 percent of these activities will be automated by 2025.
  • Harvest automation itself remains limited because of the technical difficulties in replicating the human hand to harvest delicate crops. It is anticipated that 20 percent of harvest activities will be automated by 2025.

WGCIT Hosts Workshop on Hygienic Design for Automated Harvesters

The Western Growers Center for Innovation and Technology is hosting an in-person workshop on hygienic and sanitary design for automation harvesters presented by WG’s Science Programs Director Afreen Malik and Justin Kerr, Founder of Factor IV Solutions.

The workshop will take place at the CIT in Salinas, Calif. on Oct. 31, 2022 from 8 a.m. – 10 a.m. It is open to both WGCIT startup and interested WG member companies.

USCIS: Employers To Continue Using Current Form I-9

October 20th, 2022

Employers may continue to use the current United States Citizenship and Immigration Services Form I-9, Employment Eligibility Verification, after its expiration date of October 31, 2022. According to the USCIS, a new version of the Form I-9 will be published via Federal Register notice once it becomes available. Keeping updated on which version of the Form I-9 is used is important for employers as a failure to use the approved current version can result in administrative penalties.

Employers are also reminded that Form I-9 flexibilities due to COVID-19 are extended through October 31, 2022. Temporary flexibilities were set to expire April 20, 2022, but because of ongoing COVID-19 concerns the extension was approved through the new October deadline.

Flexible rules apply in the following situations:

  • When workplaces are temporarily shut down due to the pandemic; or
  • When new hires and employees who need to update temporary work authorizations are subject to quarantine or “no travel” orders.

Despite the continued flexibility rules, employers are encouraged to begin, at their discretion, the in-person verification of identity and employment eligibility documentation for employees hired on or after March 20, 2020, and who presented such documents for remote inspection in reliance on the flexibilities first accounted in March 2020. 

To stay up to date on when important Form I-9 extensions end and normal operations may resume, employers are encouraged to monitor USCIS’s Workforce Enforcement announcements.

 

Finalists Announced for AgSharks Pitch Competition

(Oct. 21, 2022) – Western Growers and S2G Ventures have announced the three finalists that will compete in the 2022 AgSharks Competition, a unique event where startup companies pitch their innovations in front of a live audience of the world’s largest specialty crop producers to win a $250,000 minimum investment. 

The finalists are:

  • En Solucion works in the agtech sector to improve food safety through development of novel methods for cleaning and sanitizing. Current projects include exploring the feasibility of employing nanotechnology to replace traditional post-harvest chlorine wash. 
  • Nutjobs transforms nutshell waste into bio-benign plastic alternative products that are bio-based, compostable and derived from secondary agricultural waste. By transforming nutshell waste into bio-benign plastics, Nutjobs creates plastic substitutes that are cost effective and environmentally sustainable.
  • SWAN Systems helps water managers make the most out of every drop of water. The company’s configurable water and nutrient management software helps farmers make data-driven decisions about how much and when to irrigate; enabling them to apply only what is needed for optimal plant growth.

These startups will pitch their inventions to these judges in front of an audience of more than 300 fresh produce farmers and industry leaders during the WG Annual Meeting in Las Vegas on Nov. 2-5, 2022.

2023 Nonpoint Source Grant Program – Clean Water Act is Now Open for Proposals

The Nonpoint Source Grant Program – Clean Water Act is now open for proposals; the deadline to submit is Dec. 19, 2022.

The Nonpoint Source Grant Program seeks proposals for projects that reduce runoff of pollution to waters of the state of California, such as agricultural projects that reduce pesticide and nutrient runoff, improvement or decommission of dirt roads to reduce erosion and sediment runoff, streambank stabilization to reduce erosion, marina programs to reduce toxic discharges from anti-fouling paints on boats, and infrastructure improvements for ranching and livestock operations to reduce erosion and runoff of nutrients and pathogens.

The 2023 Nonpoint Source Grant Program Guidelines posted on the NPS Grant Program website describe program preferences, eligibility requirements, application process and instructions, project selection criteria and the grant award process. Please note one of the minimum eligibility requirements is to consult with the NPS Grant Coordinator in the corresponding Regional Water Board listed in Appendix 7 of the Guidelines.

First Edition of FIRA USA Attracts More Than 900 Attendees

The first edition of FIRA USA, the agtech robotics conference, attracted more than 900 attendees to Fresno from Oct. 18-20, 2022.

Voices of the Valley: Stout CEO Brent Shedd Explores Artificial Intelligence in Ag

Brent Shedd, CEO of Stout Industrial Techology, Inc., joins Voices of the Valley to examine Artificial Intelligence (AI) in the agriculture industry.

Brent joined Stout with a background in technology and tends to approach farming issues through this lens. The decision for Stout to build its own hardware and software was based around Brent’s background with AI. Brent quotes agtech engineers: “If it’s dirty, dangerous, dull, or difficult, it’s a prime candidate for automation” when looking at where robots are needed on the farm. AI is not encumbered by historical process, and it uses data to focus on output from the farm.

The podcast hosts and Brent also delve into what farmers focus on – that growers are not terribly concerned with the technology behind innovation as long as it works in the field.

Colorado’s New FAMLI Program Takes Effect January 1, 2023

Approved November 2020, Colorado’s Prop 118 has laid the groundwork for implementation of the state’s paid Family and Medical Leave Insurance (FAMLI) program. Set to take effect January 1, 2023[i], the FAMLI will significantly impact Colorado employers’ responsibilities when it comes to leave compliance.

The new program will be funded through employer and employee payroll tax contributions and will operate similar to Colorado’s unemployment insurance program. The program will be administered by the newly created Division of Family and Medical Leave Insurance under the CO Department of Labor.  

Qualified employers are those:

  • Employing at least one employee in Colorado; or
  • Who paid wages of $1,500 during a calendar quarter.

Employers with fewer than 10 employees will not be required to pay the employer share of the requisite premium but will collect and administrate only the employee’s share.

The program offers eligible employees up to twelve weeks of leave; those experiencing pregnancy or childbirth complications may receive an additional four weeks. 

The term “family member” is defined broadly under the FAMLI with leave being allowed for reasons closely related to federal Family and Medical Leave Act provisions with the exception of a “safe leave” provision allowing leave to obtain civil protection orders, receive medical or mental health care for themselves or a family member, secure their home from a perpetrator, or seek legal assistance for domestic violence, stalking, sexual assault, or abuse-related issues.

Employers with existing paid leave programs offering benefits equal to or more generous than benefits provided by the FAMLI may apply for an exemption. Employers may begin applying for exemptions in November 2022, but no later than October 31, 2023, for a plan with an effective date of January 1, 2024.

With premium collection scheduled to start January 1, 2023, Colorado employers should review the FAMLI-specific FAQs for employers located on the FAMLI website. The website provides detailed information on the program as well as employer toolkits and free webinars.

EEOC Releases New “Know Your Rights” Poster

The Equal Employment Opportunity Commission (EEOC) has updated its “Know Your Rights: Workplace Discrimination is Illegal” poster. The poster – revised as of October 20, 2022 – replaces and supersedes all prior versions of the poster including the version mistakenly uploaded to the EEOC’s website on October 19, 2022.

The “Know Your Rights: Workplace Discrimination is Illegal” poster is a summarization of federal anti-discrimination laws applicable to most private employers. Whether or not an employer is subject to federal anti-discrimination laws depends on the number of employees the business employs:

  • Having at least one employee subjects an employer to laws requiring equal pay for equal work regardless of gender.
  • Having 15 or more employees subjects an employer to additional laws prohibiting discrimination based on various protected classifications (e.g., race, color, religion, sex (pregnancy, sexual orientation or gender identity), national origin, disability and genetic information.)
  • Having 20 or more employees prohibits an employer from discriminating against employees or applicants who are age 40 or older based on their age.

The anti-discrimination notice must be posted in a conspicuous location where all employee notices are customarily posted. Notice may also be posted on an employer’s website (typically on the employer’s intranet site) where the employer has no physical location or where remote workers do not visit the workplace on a regular basis.

New Cannabis Protections for Off-Work Conduct

California’s newest cannabis legislation AB 2188 offers protection to workers whose off-work conduct includes the use of cannabis. Set to take effect January 1, 2024, AB 2188 will make it unlawful for an employer to discriminate against an individual in any terms and conditions of employment if that discrimination is based on the individual’s use of cannabis off the job and away from work.

The statute makes clear that it will continue to allow employers to implement and enforce anti-drug policies in the workplace[i] – including testing – but it does act to limit one specific aspect of testing. Employers may continue screening applicants and employees for drug use so long as it does not discriminate against an individual based on drug testing methods that screen for nonpsychoactive cannabis metabolites (NCM).” In other words, employers cannot weed out applicants or employees based on drug tests that report a finding of metabolized tetrahydrocannabinol (THC) in the body.

According to Legislative findings, “THC is the chemical compound in cannabis that can indicate impairment and cause psychoactive effects.” However, once metabolized and stored in the body as NCM, THC no longer is an indicator of current impairment but merely an indicator of past consumption.

The new legislation does have its limits in that it does not apply to:

  • employees/applicants in the building and construction industry
  • applicants/employees hired for positions that require a federal government background investigation or security clearance; or
  • preempt state or federal laws requiring applicants/employees to be tested for controlled substances including laws and regulations requiring applicants or employees to be tested, or the manner in which they are tested, as a condition of employment, receiving federal funding or federal licensing-related benefits, or entering into a federal contract.

Although AB 2188 does not take effect until January 1, 2024, employers should begin the process of auditing current screening methods to ensure third party testing vendors will be able to provide compliant testing results by the 2024 deadline. A change in the law, even though it may not directly impact internal policies, is always an opportune time for review to ensure compliance and that handbook and safety policies/procedures are in keeping with current company practices.


[i] AB 2188 (Govt. Code Section 12954(b)) specifically provides, “[n]othing in this section permits an employee to possess, to be impaired by, or to use, cannabis on the job, or affects the rights or obligations of an employer to maintain a drug- and alcohol-free workplace.”
