Western Growers Announces Ron Ratto as New Chairman of the Board

IRVINE, Calif. (October 29, 2018) – Western Growers today announced that Ron Ratto, president of Ratto Bros., Inc., has been elected as Chairman of the Board of Directors. Taking over volunteer leadership responsibilities from Outgoing Chairman Craig Reade, partner at Bonipak Produce, Ratto will serve as chairman for a one-year term. He joined Western Growers’ Board in 2013 and has served numerous roles including senior vice chairman and Political Action Committee chairman.

“Ron has made significant contributions in his current role as a board member and senior vice chairman, advancing both the innovation and advocacy side of agriculture,” said Western Growers President and CEO Tom Nassif. “I look forward to working with him as our new chairman, along with the rest of the board, to support the ongoing growth of Western Growers in support of our members and the fresh produce industry as a whole.”

Ratto heads Ratto Bros. with his cousins Ray, David and Frank Ratto. Born in 1951, he received a degree from the College of Agriculture at University of California, Berkeley, and always knew he was going to join the family business. Today, the family-owned business farms over 1,000 acres of farmland near Modesto, California, growing a variety of crops including fresh herbs, greens and other vegetables. The farm takes pride in implementing progressive farming practices and investing in the latest technological advancements, including a high-tech cooling and packaging facility, state-of-the-art irrigation pumping and filtration stations, an on-site solar installation, a robust food safety team and an in-house computer program that can track the dozens of specialty-type vegetables crops.

“For more than nine decades, Western Growers has provided the crucial guidance and support needed to help farmers continue to feed the nation and world,” said Ratto. “As a fifth-generation farmer, I understand how precious this resource is and am honored and humbled to lead the board of directors as we continue to deliver value to fellow farmers.” 

Ratto was named as 2019 chairman during Western Growers 93rd Annual Meeting in Palm Desert, California. During the meeting, the Board also selected Ryan Talley of Talley Farms as senior vice chairman; Albert Keck of Hadley Date Gardens as vice chairman; Carol Chandler of Chandler Farms as treasurer; and Vic Smith of  JV Smith Companies as secretary. Additionally, the Board welcomed new board members Franz DeKlotz of Richard Bagdasarian, Inc.; Brandon Grimm of Grimmway Farms; Alex Muller of Pasquinelli Produce Company; Dominic Muzzi Jr of Muzzi Family Farms, LLC; John Jackson of Beachside Produce LLC; and Kelly Strickland of Five Crowns Marketing, Inc.

Fox News’ Andrew Napolitano Shares Insight on Current Political Environment during PAC Lunch

Western Growers Political Action Committee Chairman Albert Keck opened the PAC Lunch thanking attendees for their support of Western Growers PAC. WG’s PAC provides critical campaign support to elected officials and candidates who support our industry.

“Your support here today will help amplify our members’ voices in political contests in California, Arizona and across the country,” said Keck. “With the hotly contested midterm elections next week, and control of both the House and Senate up for grabs, we are reminded of the importance of engaging in the political process.”

After lunch, guests turned their attention to the PAC Lunch speaker, Fox News’ Senior Judicial Analyst Judge Andrew Napolitano, who shared insights on the current political environment.

“I often argue that we don’t have a two-party system,” said Napolitano. “We have one. The government party.”

Advances in Genomics Discussed during Educational Workshop

Sammy Duda, senior vice president of national operations at Duda Farm Fresh Foods, emceed the Genomics Workshop yesterday afternoon. During the workshop, leading experts in genomics discussed how advances in genomics could transform agriculture.

To kick off the event, Juan Enriquez, one of the world’s leading authorities on the uses and benefits of genomic research, shared a presentation on genomics and how advancements in the field will fundamentally change life in the future. Following Enriquez’s presentation, there was a panel discussion on the application of genomics to food production and how to ensure consumer acceptance of new technology. Jan DeLyser, Vice President of Marketing for the California Avocado Commission, and Danny Royer, Vice President of Technology for Bowles Farming Company, joined Enriquez and Duda for the panel.

Anniversaries, Golf Tournament Winners Lauded at Party with the Partners

The 2018 Western Growers Party with the Partners was a night filled with celebration and kudos. In addition to thanking all of WG’s tremendous industry partners, the event was dedicated to recognizing the family farms who have been WG members for 50, 60 and 70 or more years.

“They are a testament to the staying power of our industry and our organization,” said Kim Sherman, director of membership at Western Growers, during the award ceremony. “In truth, they provide Western Growers with the credibility that allows us to be effective advocates for fresh produce farmers in Arizona and California.”

Automation Startup Wins Fast Pitch Competition with Game-Changing Tech to Reduce Global Food Gap

Western Growers, S2G Ventures offers $250,000 in seed funding to Augean Robotics for development of autonomous farming robot

IRVINE, Calif. (October 30, 2018) – Augean Robotics walked away from Western Growers’ AgSharks™ Competition today with a $250,000 equity investment offer, as well as access to farm acreage for pilot testing, to take its collaborative robotic platform from development to market. The seed funding was awarded by S2G Ventures (Seed 2 Growth) after competing against four other start-up companies who also are inventing new technology solutions to solve agriculture’s most pressing issues.

By 2050, the world’s population is expected to reach 9.1 billion, and the United Nations’ Food and Agriculture Organization predicts that food production will need to increase by as much as 70 percent to feed the growing population. In an effort to identify new and innovative technologies that will play a role in improving global food security, Western Growers created the first agtech competition to offer real-time investment opportunities and decision-making in front of a live audience — AgSharks.

“If we are going to continue providing safe and healthy food to a growing population, there needs to be a systemic transformation of the way we cultivate our food. That’s where technology comes in,” said Tom Nassif, president and CEO at Western Growers. “Providing growth opportunities for cutting-edge companies such as Augean Robotics will play a significant role in improving how we farm so we can dramatically increase food production. Also, investing in these innovations will be crucial to minimizing our need for manual laborers through automation and reducing our environmental footprint through efficient water use.”

Augean Robotics is a hardware/software/data company building robots to help farmworkers work more productively, with the long term objective of automating all of the tedious work performed on the farms and outdoors. Their product, Burro, is a robotic platform that follows workers, moves cargo autonomously, and captures the data needed to further automate farm work. Their technology will enable farmers to make improvements in operational efficiencies, facilitating the growth and future of U.S. farms to produce a sustainable supply of fresh produce.

“In S2G and Western Growers, we see a group with boots on the ground and eyes on the horizon – keenly aware of the day to day needs of farmers and the incredible potential for robots in agriculture over the coming decade,” said Charles Andersen, CEO of Augean Robotics. “We are honored to have their support and look forward to working together as we bring collaborative robots to the industry that needs it most.”

During the competition, the agtech startups pitched to six expert judges and a live audience where they were evaluated on the strength of their solution and potential to scale, among other assessment categories. The panel of judges, which were comprised of venture capitalists and leaders in the agricultural industry, provided feedback to each startup and advanced Augean Robotics to earn the investment offer.

“We continue to value this partnership with Western Growers and their members,” said Sanjeev Krishnan, S2G Ventures’ chief investment officer and managing director at S2G Ventures. “By providing capital to the entrepreneurs at Augean Robotics and WG’s market knowledge, we can feed the changing consumer and generate increased profits for the producers.”

Krishnan was among the judges’ panel, which also included Kevin Andrew, chief farming officer at Vanguard International; Robby Barkley, president & CEO of Barkley Ag Enterprise; Cristina Rohr, vice president at S2G Ventures; Vic Smith, president & CEO of JVSmith Companies; and Matthew Walker, managing director at S2G Ventures.

AgSharks premiered last October, where two agtech startups – Hazel Technologies and AgVoice – received a $2.25 million total investment offer from S2G Ventures. AgSharks is the latest WG effort to identify key innovations in the fresh produce industry and support agtech startups in bringing their technology to market. Previous efforts include opening an agtech incubator—the WG Center for Innovation & Technology—in December 2015, and launching the AgTechx Summit series, which brings new ag technologies to major farming regions.

Craig Reade Gives Farewell during Chairman’s Lunch

Words of inspiration filled the room yesterday during the Chairman’s Luncheon & Keynote. The event included a moving farewell address from outgoing chairman Craig Reade.

“The increasing regulations on agriculture are an increasing burden,” said Reade. “Technology allows us to overcome these regulations. Millennials understand how to adapt to use technology and the innate innovativeness of millennials will allow agriculture to thrive.”

After Reade’s address, Former Navy SEAL and Special Operator Robert O’Neill shared his insights on leadership, decision-making and operating in uncertain environments and becoming the best of the best.

“Bravery is recognizing fear and putting it aside,” said O’Neill during his keynote. “Put your head down, don’t give up and keep moving forward.”

Guests Leave Arbinger Workshop with Tools to Influence Results

The topic of company culture was top of mind during the “Changing Minds to Influence Results with Arbinger” session yesterday afternoon. Mike Merchant, senior consultant for the Arbinger Institute, started the workshop with a brief overview of philosophical underpinnings of Arbinger and later went one to facilitate two hands-on sessions to further demonstrate the principles of Arbinger.

This jam-packed session also included a panel where Vic Smith of JV Smith Companies; Kevin France of SWIIM System; Eric Reiter of Reiter Affiliated Companies; and Kelly Strickland of Five Crowns Marketing discussed their experiences incorporating Arbinger into their own workplaces.

Steve Patricio Honored for His Significant Contributions to Ag

Western Growers honored Stephen (Steve) Patricio with the 2018 Award of Honor last night. Patricio, whose visionary leadership has advanced the agricultural industry by leaps and bounds, was honored with Western Growers’ Award of Honor.

In addition to the Award of Honor, Patricio was also presented a resolution from the California Legislature – a Joint Members Resolution from Representatives Anthony Cannella, Heath Flora and Adam Gray.

Preceded by introductory remarks from WG President & CEO Tom Nassif, Patricio delivered an inspirational speech that resonated with each and every guest.

“Western Growers are the better kids. They are the best kids,” said Patricio. “Hanging around these kids have made me better. They are my family for life.”

Jon Dorenbos—Philadelphia Eagles Long-Snapper, magician and inspirational speaker—closed out the night with a riveting show that showcased his skills as a magician. During the show, Dorenbos also shared his incredible life story and positive outlook to help inspire others to overcome their own obstacles and embrace change.

How Do You Deal With Payments That are Short Pay or Have Full and Final Payment Preprinted on the Check

It is more common than shippers would want to experience, but there are times where your buyer will remit less than the original invoice amount by taking an unauthorized deduction from your invoice. At the same time, the remittance may have restrictive language disclosing that deposit constitutes full and final payment.

Below are some helpful steps to consider taking:

  1. Immediately phone/email and document, your disagreement with the payment amount to the buyer, and that you are seeking the full balance due.
  2. If your internal investigation confirms no dispute on the sales contract with your buyer, communicate verbally and in writing that the check is being processed as payment on account, and that there is a balance due you expect to be paid in full on.  Document your action in an email and highlighting partial payment and the balance due amount.
  3. If you have a lockbox, follow the above process immediately upon notification from your bank.
  4. If you are aware that there is a bona fide dispute, you should not deposit the check until the issue can be resolved, or the check can be released as the undisputed amount through an informal administrative action with PACA.
  5. Each and every dispute is unique, so please consult Western Growers, or your legal counsel before you take action.

Again, every situation will have a different set of facts, but always consider the practical (common sense) approach as to whether or not you should deposit the check. If it is a customer who you routinely do business with, it may be appropriate to deposit and simultaneously communicate your position on the balance due. Alternatively, if it is a customer which you may have some trepidation with, about their financial condition, it would make sense to process the check, if the balance due is negligible, and simultaneously document the position that the remittance is payment on account and that the balance due is payable.  

Separately, if you have been informed of a claim, or an arrival notification with an inspection, and the check is tendered with not only restrictive language, but it has written communication that makes it unequivocally clear payment is full and final, you should not deposit that check. This action will create an accord and satisfaction in the eyes of the PACA and will jeopardize your right of recovery.  In these situations, timeliness is imperative and you need to immediately dispute the tendered amount and then consider filing a PACA informal administrative action.  At that time of filing, you can request the PACA obtain the release of the funds as the undisputed amount due and owing without prejudice to the rights of either party.

While these matters of restricted endorsements are not common place, how you address them when they arise should be planned in advance between your accounting and sales department.
