Updated California Family Rights Act Notice and Form Available

The Department of Fair Employment and Housing (DFEH) has prepared a new Joint Notice for Family Care and Medical Leave (CFRA Leave) and Pregnancy Disability Leave for employer use. A Spanish translation of the notice is expected to be released soon. 

The new joint notice is worded differently than the prior version of the notice (“Notice B”). In a notice dated July 15, 2015, DFEH said that it is aware of this discrepancy and that employers will not be penalized as long as either notice is posted. The Fair Employment and Housing Council is currently reconciling these notices with a rulemaking action to discontinue use of a joint notice, which will result in the publication of one notice for CFRA Leave and a separate notice for Pregnancy Disability Leave after the rulemaking action is approved and becomes effective.

As Spotlight previously reported, new amendments to the CFRA took effect on July 1, 2015. Pursuant to the amendments, the required workplace poster has been updated, a new medical certification form has been added, and previous language from CFRA that permits the use of the U.S. Department of Labor’s sample medical certification form has been removed, among numerous other changes. As of July 1st, employers should be using the sample CFRA certification form.

Every employer must post a notice explaining the CFRA provisions and procedures for filing complaints “in conspicuous places where employees are employed.” Employers must post the notice “where it can be readily seen by employees and applicants for employment.”

Leaving Money on the Table — Billions of Settlement Dollars Go Unclaimed

WG Pushes for Permanent Seasonal Workers’ Fix in Affordable Care Act

Western Growers is promoting a small, but important, legislative fix to the Affordable Care Act (ACA) that would help employers determine the healthcare eligibility for their seasonal workers. The legislation, known as the Stars Act (Simplifying Technical Aspects Regarding Seasonality), aims to permanently codify IRS regulations defining who is considered a “seasonal worker” under the law. As it now stands, the only definitions of seasonal workers that exist are contained in IRS regulations. Those regulations can be altered by a future administration.  

Considered a technical correction to the law, the Stars Act faces an uphill political battle, but that hasn’t stopped Western Growers from pursuing a fix for members extending back nearly three years. Dennis Nuxoll, vice president for federal government affairs in WGs’ Washington, D.C. office, said Western Growers has been “one of the organizations that has helped to frame and propel the legislation” over the past two Congresses. 

As a result of our involvement with a multi-industry coalition, as well as with the Obama administration and congressional offices, legislation has been introduced in both the House and Senate that would put into statute language that defines what a seasonal worker is. Why is that important? According to Nuxoll, “Regulations can change from administration to administration, so it’s important to prevent future changes by making the regulation permanent.” He added, “Codifying the definition provides employers with some level of reliability when applying the language to their own operations.” 

Genesis of the Legislation

A coalition of various industry groups, led by Western Growers, was concerned that there was no definition in statute or in regulations that defined seasonal employees and how they are to be treated under the law. Are seasonal workers considered full–time employees? Were they defined by the amount of hours they worked or by the amount of time they worked for an employer? If they were considered full-time employees, then they were entitled health care benefits under the ACA. But the bottom line is no one really knew.  

The broad-based coalition that formed was an unusual alignment of industries consisting of a cross section of groups who employed large numbers of seasonal employees. Besides the specialty crop industry, the coalition included members from nurseries, greenhouses, and the recreational and tourism industries.   

Originally, WG and the coalition pushed for a definition of seasonal worker to be someone who worked for an employer for seven months. The IRS countered and instituted regulations defining a seasonal worker as someone who worked for an employer for six months plus 1 day. This is the definition that the STARS Act is attempting to codify.    

Jonathon Alexander, general counsel at Western Growers Assurance Trust said, “The STARS act will help employers avoid misclassification of their workforce so that they don’t run afoul of the large employer mandate penalty. It prevents future regulatory modification of the definition of seasonal employee; protecting employers from potential increased liability and expenses.“

The Political Rub

Unfortunately, the politics surrounding the ACA is quite volatile and although the STARS Act represents a simple technical fix, both Democrats and Republicans have reservations about passing legislation to address the issue. Republicans, many of whom would like to repeal the ACA entirely, are reticent to move legislation that addresses fixes for fear of legitimatizing a law to which they are philosophically opposed. Democrats, on the other hand, fear that any redress of the legislation points out flaws in the bill, opening it to further attack by Republicans. It remains to be seen how or if the House and or Senate will advance the legislation, but the most likely means will be by attaching it to other legislation that is being moved.

The Legislation

The Stars Act introduced in the House has 58 co-sponsors, several from the California delegation, including: Representatives Jim Costa, Doug LaMalfa, David Valadao and Devin Nunes, as well as Scott Tipton from Colorado and Mark Amodei from New Mexico. The companion bill in the Senate was introduced by Senator Kelly Ayotte (R-NH) and is awaiting further action by the Senate Finance Committee.

WG Board to Convene Tomorrow in Newport Beach

Western Growers Chairman Vic Smith will gavel to order the Orange County Board of Directors meeting tomorrow morning in Newport Beach. Committee meetings are scheduled all day on Wednesday and will include discussions on a variety of topics affecting the industry, including water, labor, food safety, agtech, legislative proposals, trade, and transportation issues. The full board will meet on Thursday to report on their respective discussions and to take up any items passed out of the committees. Additionally, members of the Executive and Audit Committees convened today at Western Growers Irvine office.

UFW Files Access Notices on California Farms

UFW has been actively filing ‘Notices of Intent to Take Access’ with the Agricultural Labor Relations Board (ALRB). Over 30 access filings have been submitted over the last 30 days. UFW organizers have visited a number of farms along the southern and northern coasts and the Central Valley. 

In those instances when the UFW has taken access, it has typically occurred during the meal break. Organizers are asking employees about employer compliance with the heat illness regulations and passing out a heat illness compliance document asking for the workers’ contact information to be returned to the UFW. 

Should the UFW serve your company with a ‘Notice of Intent to Take Access,’ please note that the union will not be allowed to take access until such time that you receive notification from the Regional Director of the ALRB that the Access Petition has been filed.

Secondly, once properly filed, the UFW may take access to your agricultural operations three times daily: one hour in the morning before the start of work; one hour, which shall encompass the meal period; and one hour after the end of work. Two organizers per crew (up to 30 workers may take access); and one additional organizer for every 15 additional workers. Organizers must wear a badge identifying themselves by name and name of the union; and must identify themselves upon request.

Organizers may access your fields and/or employee parking lots one hour before the start of work, one hour following the end of work, and one hour which shall encompass the meal period. If employees take a 30-minute meal period, the UFW may arrive 30 minutes early, before the start of the meal period, or stay 30 minutes after the end of the meal period, with no interruption of work.

While on the premises, please have your supervisory employees vacate the immediate area where organizers may be talking to workers or distributing literature. Supervisors should be out of eyeshot and earshot –a safe distance is at least 100 yards.  Additionally, please inform your supervisors not to interrogate workers about what the UFW has said or gave to them when the union organizers leave.  This would constitute an unfair labor practice.

If you use farm labor contractors, their employees will be deemed your employees for purposes of the Agricultural Labor Relations Act. Therefore, please contact your labor contractor concerning access by union organizers before they begin access. Be sure that the same rules that apply for your supervisory employees also apply for those of the farm labor contractor.

If you have on-farm rules (e.g., signing in at a gate before accessing the ranch, food safety, speed limits), it is appropriate to consistently enforce these rules with union representatives. Finally, workers should be advised that they are not required to sign union authorization cards nor are they required to provide their home addresses and telephone numbers if they are requested by UFW organizers as part of this process.

Canadian Opposition Party Lauded for Committing to PACA-like Program for Produce Sellers

Last week, the leader of Canada’s New Democratic Party (NDP) — in advance of this fall’s federal elections — made a platform commitment to introduce payment protection for produce sellers similar to the Perishable Agricultural Commodities Act (PACA) offered in the United States. The Canadian Produce Marketing Association and the Canadian Horticultural Council praised NDP leader Thomas Mulclair for taking a strong position on the issue, one that is considered by them as their top issue in the election. According to The Produce News, “The highly perishable nature of fresh produce makes the industry uniquely vulnerable during bankruptcies, risking financial ruin for those affected.” 

A payment protection system has been long-sought by growers and sellers, especially since last October, when the United States government revoked Canada’s preferential treatment under PACA leaving their exports shipped across the border vulnerable to accessing administrative relief for non-payment and disputed contract issues.  The preferred treatment was revoked since Canada lacked a payment protection system of its own, an issue the U.S. had pushed for decades. Growers and sellers challenged leaders in other parties “to show their support of Canada’s produce industry by making this issue a priority in their platforms.”

Western Growers senior executive vice president, Matt McInerney, who has worked closely for years with the Canadian produce industry on this issue, expressed his optimism with the very public position taken by the NDP.  “Western Growers has long-advocated the need for the Canadian government to offer a financial risk mitigation tool for the entire produce supply chain in Canada. The commitment by the NDP energizes the conversation about protection for the produce sector. We applaud this platform position and hope that following the October elections, the newly formed government will move expeditiously to implement a payment protection plan that will be offered to all those selling produce throughout Canada.”

WG Board Wraps-up Orange County Meeting

The Western Growers Board of Directors wrapped-up a successful meeting today in Orange County, having deliberated top issues affecting the fresh produce industry. Chairman Vic Smith of JV Smith Companies led two days of committee meetings and a general session that included policy discussions on water supply, labor, food safety, trade, transportation issues, and innovation.    

With water issues high on the list of priorities, it was timely that Senators Dianne Feinstein and Barbara Boxer introduced legislation to address the drought ravaging California and much of the West. Western Growers took the opportunity to issue a statement by President and CEO Tom Nassif praising the introduction of the California Emergency Drought Relief Act of 2015. Nassif also expressed the urgent need for the Senate to act quickly on legislation that addresses the needs of all western states being affected by drought.

Following the board meeting, Nassif was thankful for the progress and consensus reached by directors on difficult issues they face as growers and shippers of fresh produce. “It was an extraordinary meeting and I am always encouraged by the intense amount of work that gets accomplished at the committee level by the volunteer members of our board. Their dedication to the association and the industry is invaluable and is always appreciated,” Nassif said.

The next board meeting will take place in November during Western Growers’ Annual Meeting in San Diego at the Grand Del Mar.

We also want to express our appreciation to Rep. Jim Costa and the other 13 California co-sponsors of the legislation, and to all the members who voted today to bring modest relief to millions of Americans suffering from the combination of drought and unbalanced regulatory policies governing water.  
 
The focus now shifts to the Senate. We are encouraged by recent statements from Chairwoman Lisa Murkowski indicating that she will continue working with her colleagues in Congress ‘to advance legislation that ensures that federal actions mitigate the impacts of drought,’ as well as Senator Dianne Feinstein’s commitment today to working with members across the aisle to reach ‘an agreement that can advance through both chambers.’
 
With every day that passes, our ability to stem the social, economic, and environmental harm caused by the drought and unbalanced policies diminishes. It is time for western senators to engage on behalf of their states and to build support among all of their colleagues in the Senate. “We want to express our thanks to Senators Feinstein and Boxer for re-introducing much needed legislation aimed at alleviating the short and long-term impacts of the historic drought in California. The bill that has been submitted today provides a basis to reconcile their bill with the recently passed House legislation. There is no time to waste as the impacts of the drought —  exacerbated by an unbalanced regulatory scheme — are deepening in California and throughout the West. It’s time to advance reasonable legislation before more family farms and communities are forced into economic disaster. 

Our attention must also turn to passage of a western water bill to address the needs of other states being affected by the drought. Any effort aimed at helping California must be combined with efforts to devise solutions to problems faced throughout the West as a result of long-term drought. For example, the Colorado River Basin is currently experiencing its driest period in 50 years. While recent atypical summer rain storms have provided some relief, it is clear that members of the Senate must come together to address common concerns throughout the West. Western Growers urges the Senate to act quickly.”

Like our previous Annual Meetings, this year’s event promises to be memorable, featuring one of Southern California’s most spectacular resorts. For three days, you will have the opportunity to connect with old friends, make new ones, and learn about the latest technologies, trends and issues in the fresh produce… all while having a little fun.

Festivities begin Sunday, November 8, at our Welcome Reception held on the resort’s Aria Lawn, which the hotel describes as being “accentuated by a dramatic pavilion and views of the resort’s golf course and canyon preserve.” What better way to start your week than mixing and mingling under the stars on a beautiful San Diego night?

Forget starting your week off with the Monday blues as you prepare to take in two of our scheduled workshops on November 9. Join Top Chef’s vivacious Shirley Chung for a lively cooking demonstration that is sure to challenge and inspire your culinary talents. Then stay involved with the WG Political Action Committee Luncheon, where Stuart Varney, a Fox News contributor and co–host of Varney & Co. on the Fox Business Network, will opine on the national and global economy and political landscape. On Tuesday, November 10, we’ll turn to AgTech as we entice entrepreneurs to “Step into The Innovation Arena.” A “Shark-tank” like format, this workshop will place several aspiring ag innovators before a panel of influential growers and shippers who just might be willing to invest in their ideas. During the Major Lunch, WG Chairman Vic Smith will give the Chairman’s Address, and will be followed by former Cisco Chief Futurist, Dave Evans. Evans holds a number of patents and will offer his insights on emerging technologies and how those technologies will affect agriculture and humankind. He has been designated as one of the 150 Most Influential Thought Leaders in the World by LinkedIn.

After lunch, in our second workshop of the day, a panel of legal and policy experts from California and Arizona will examine challenges to water rights and share their insights about the conflicts looming over farm water use in the increasingly urbanized West.

On Tuesday night, we will gather for the Chairman’s Reception and to honor this year’s Award of Honor recipient, former WG Chairman, Bob Gray. Following the recognition of our former chairman, attendees will have their funny bone tickled by film, television and radio personality, Tom Papa, who is sure to bring the house down.

On Wednesday, be sure to stick around for our golf tournament held on property at the Tom Fazio-designed Grand Del Mar Country Club. This is one of San Diego’s premier golf destinations.
