WG Urges CA Water Commission to Support Sites and Temperance Flat Reservoir Projects

As part of the regulatory process for distribution of $2.7 billion in water storage funds authorized by Proposition 1 – the 2014 water bond – the California Water Commission is currently accepting project applications through August 14, 2017.

WG has submitted comments to the Commission in support of both the Sites Reservoir and Temperance Flat Reservoir projects. The WG comments note that California voters approved the 2014 water bond with the expectation that the state would build new water storage projects.

In fact, the official ballot argument in support of Proposition 1, signed by Governor Jerry Brown and others, stated that the water bond, “invests in new storage increasing the amount of water that can be stored during wet years for the dry years that will continue to challenge California.”

WG also noted the crucial link between surface storage capacity and groundwater recharge, especially in light of changing precipitation and runoff patterns due to climate change and the forthcoming requirements of the Sustainable Groundwater Management Act.

“As surface water storage projects, Sites and Temperance Flat provide the only means of capturing and storing heavy snowmelt and rain runoff – especially in wet years – that can be later utilized for groundwater recharge.”

The proposed Sites Reservoir, an off-stream facility that would store excess flows from the Sacramento River north of the Delta, would add up to 1.8 million acre feet of capacity, while Temperance Flat Reservoir, which would be located on the San Joaquin River, would create an additional 1.26 million acre feet of water storage.

Western Growers Signs onto Amicus Brief Asking for Supreme Court Review of Critical Habitat Decision

Western Growers, along with the non-profit Coalition for a Sustainable Delta (CSD) and the San Luis & Delta Mendota Water Authority, recently filed an amicus brief in Markle Interests v. U.S. Fish and Wildlife Service

In the brief, the signors urged the U.S. Supreme Court to grant review of the petition of Markle Interests, a timber company based in the Southeast. By a vote of 2-1, a panel of the United States Court of Appeals for the Fifth Circuit affirmed a decision by the Fish and Wildlife Service (USFWS) to designate areas as “critical habitat” for the dusky gopher frog that the frog could not previously inhabit. They are considered critical habitat areas because they contain a single biological or physical feature necessary for the survival of the species. 

The brief argued that the habitat of a species must contain the combination of attributes necessary to support that species, and that designation of areas as critical habitat, that cannot support the species, is contrary to the plain language and legislative history of the Endangered Species Act. The brief also pointed out that large swaths of land across the West are already designated as critical habitat and that these would assuredly grow if USFWS was permitted to designate non-habitat as habitat. The U.S. Chamber of Commerce, 18 states, and a number of other entities provided amicus support for Supreme Court review, although the aforementioned brief offers a uniquely western and agricultural perspective. Western Growers and CSD are represented by, and the brief was drafted in part by, attorneys Paul Weiland and Robert Thornton with Nossaman LLP’s Irvine office.

It is anticipated that the court will decide whether to take the case in late fall 2017.

Western Growers’ Statement in Support of SB 623

IRVINE, Calif. (August 23, 2017) – Western Growers Executive Vice President Dave Puglia released the following statement following the press conference that was held in support of SB 623 (Monning — Carmel), a bill that provides clean drinking water to disadvantaged communities that do not have access to or cannot afford clean drinking water:

“The act of farming necessarily requires nutrients in the soil to be replenished to allow for the continued production of crops. The use of organic and commercial fertilizers are necessary to replenish soil nutrients to allow for crop production. We believe it is in the best interests of the people of the state of California to have a safe and secure food supply grown in California for the benefit of people everywhere. To accomplish this, agriculture must be able to continue to use nitrogen-based fertilizers to replenish soil nutrients and ensure healthy crop production.

The United States’ government and the land grant universities encouraged and guided farmers on application of nitrogen fertilizer for over half a century to increase food production and efficiency, and farmers have relied on and used that advice and guidance, which represented the best management practices of the time.

Even though agricultural practices of today significantly reduce or eliminate the potential for nitrates to reach the groundwater, farmers and researchers are continuing to seek opportunities to improve management practices.

Due to the challenges of reconciling nitrogen use by agriculture with human health and water resource protection, we have been working with the environmental justice community, as well as other stakeholders, for over a year in an effort to address the critical needs in disadvantaged communities relating to safe drinking water. Since these challenges are numerous, both from naturally occurring contaminants and human sources, we believe the solution should be shouldered by a broad array of stakeholders.

SB 623 strikes the needed balance between providing the necessary resources for addressing critical drinking water needs, while protecting agriculture from certain nitrate related enforcement actions in the short-term.”

Jim Gaffigan Brings Comedy to WG Annual Meeting in Las Vegas

Grammy-nominated Comedian Jim Gaffigan will be taking the stage in Las Vegas, Nevada, on Monday, October 30 during the Western Growers 92nd Annual Meeting.

Known as the “King of Clean Comedy,” Gaffigan proved his comic merit and steadily climbed the ladder to stand-up success, eventually landing an appearance on David Letterman’s talk show Late Show with David Letterman. He has made guest appearances on countless hit TV shows including That ’70s Show, Sex and the City, Third Watch, Ed and Law & Order. In addition to his comedy and acting career, he has produced several successful comedy specials, including Mr. Universe and Jim Gaffigan: Obsessed—both of which received Grammy nominations.

Gaffigan also touts being a New York Times best-selling author, top touring performer and multi-platinum-selling father of five. Using little provocative content in his routines, Gaffigan is known around the world for his unique brand of humor which largely revolves around fatherhood and his observations on life and food.
