Colorado To Allow Regulated Use of Psychedelic Mushrooms

A newly passed Colorado initiative to decriminalize possession and limited use of psychedelic mushrooms and other plant-based psychedelic drugs was passed by Colorado voters on November 8, 2022. Known as the Natural Medicine Health Act of 2022, the ballot initiative will allow supervised use of two specific compounds, psilocybin and psilocin, found in psychedelic mushrooms at state regulated healing centers.

The measure was put forward in response to growing trends in the use of psychedelic drugs to treat certain mental health disorders (e.g., depression and post-traumatic stress disorder). The initiative does not go into effect until 2024 which allows the state plenty of time to form its mandated Medicine Advisory Board to advise the Colorado legislature and other state entities on exploratory research and health benefits attributed to the limited use of psychedelic mushrooms and other plant and fungi derived psychedelic drugs.

The initiative is clear it does not weaken an employer’s right to maintain a drug-free workplace; specifically, providing that it does not “require an employer to permit or accommodate the use, consumption, possession, transfer, display, transportation, or growing of natural medicines in the workplace.” In addition, Colorado law does not require an employer to accommodate use of cannabis in the workplace. However, employers will definitely be concerned about how the medically authorized use of psychedelic mushrooms will fit into the workplace picture.

Although the initiative does not go into effect until 2024, a change in the law, even though it may not directly impact internal policies, is always an opportune time for review to ensure compliance and that handbook and safety policies/procedures are in keeping with current company practices.

Cal/OSHA Removes ‘Exclusion Pay’ from Non-Emergency COVID-19 Standard

Cal/OSHA has announced it will be dropping ‘exclusion pay’ from its forthcoming Non-Emergency COVID-19 Standard. It was anticipated that a decision concerning exclusion pay would be made in time to allow a seamless transition at the end of this year when the existing Cal/OSHA COVID-19 Emergency Temporary Standards (ETS) expire.  

The October Cal/OSHA Standards Board meeting saw much debate over whether the current ‘exclusion pay’ mandate should be added to the new non-emergency standard. Concerns over the inevitable months-long delay that would have impacted implementation of the new standard pushed the Board to remove the exclusion pay requirement going forward. With the next Board meeting scheduled for December 15, 2022, it is anticipated that the new standard will take effect at the first of the year.

Employers should continue to comply with the current ETS until the non-emergency standard takes effect.

Western Growers Debuts ‘Real Farmers Care’ Video for Thanksgiving

IRVINE, CALIF. (Nov. 22, 2022) – Western Growers is debuting a documentary short video online for Thanksgiving that demonstrates the care California farmers put into growing the food that will be consumed this holiday season.

The video features Colby Pereira, Braga Fresh Family Farms; Martin Jefferson, Duda Farm Fresh Foods; Mark Mason, Huntington Farms; and Jynel Gularte, Rincon Farms.

“Real farmers care about you, the consumer – your health, your safety, the quality and flavor of your fresh produce,” Mason says in the video. “Because we feed our families the same fruits and vegetables we feed yours.”

VofV: Trimble’s Mike Dentinger on Strategies to Reach the Finish Line with Global Harvest Automation

As the data for the next edition of Western Growers’ Global Harvest Automation Report are being crunched, Mike Dentinger, the Director of AG OEM Development at Trimble, joins the podcast to discuss the potential of automated harvest becoming a day-to-day reality soon.

“It’s a really tough equation,” he says. “How many carrot harvesters does California really need that Grimmway isn’t already building themselves?… And what is it going to take to do this if it ends up being a one million or two million dollar machine and you are going to sell 12 of them a year? The math really falls apart very quickly.”

The key to getting to the finish line, he says, is to figure out where the commonalities exist in specialty crop harvest automation and then innovate from that point. For instance, 80 percent of that hypothetical carrot harvester can have common components, and the rest could be swapped out per the needs of the particular commodity. “You don’t have to swallow the elephant in one bite,” Mike says. “You can take it in pieces.”

Register for the Desert Agriculture Research Symposium on Nov. 16

Registration is now open for the Desert Agriculture Research Symposium, held by the Yuma Center of Excellence for Desert Agriculture. The symposium brings together desert agriculture industry professionals with the goal of stimulating conversations about how researchers can best apply their expertise to the desert growing system and form effective collaborations that lead to new knowledge or tools that can be used by growers.

Some of the day’s sessions will include conversations about the value and need for industry-academia collaborations, addressing industry challenges and learning about industry-focused research efforts in the Yuma area.

Western Growers’ Dennis Donohue Leads Panel on Emerging Tech at Gowan Global Gathering

The Gowan Company celebrated its 60th anniversary last week at the Gowan Global Gathering, where Dennis Donohue, Executive Director of the Western Growers Center for Innovation and Technology, lead a panel on Emerging Tech.

An estimated 600 attendees gathered at the event, which was hosted at Gowan’s headquarters in Yuma, Arizona.

Gowan Group is a global, family-owned agriculture solutions business. The company specializes in developing, marketing, and manufacturing global agriculture inputs, such as crop protection products, seeds and fertilizers.

Western Growers Mourns the Passing of Tom D. Bengard

The Western Growers Family of Companies mourns the passing of former board member Tom D. Bengard, patriarch of Bengard Ranch and a beloved agricultural industry veteran.

Tom came from a family of true agricultural pioneers in the Salinas Valley. His grandparents, James Bardin and Wes Eade, journeyed to California in the late 1800s in search of rich farming and grazing land. A little less than 100 years later, grandchildren Tom and Terry Bengard established Tom Bengard Ranch, Inc. in 1961 as a grower-shipper operation.

During the farm’s humble beginnings, Tom tended to his farm of sugar beets, small white beans, potatoes and Spring lettuce, later transitioning to row crops as he accrued more land. No stranger to hard work, Tom did most of the labor himself at the start and could often be seen around his farm driving tractors, planting, irrigating, and even performing shop repairs.

Tom served as a Western Growers board member from 1984 until he retired in 2000, passing Bengard Ranch on to the next generation of farmers. His son Bardin, President of Bengard Ranch, has served as a board member of Western Growers since 2001.

Today, Tom’s legacy continues to live on. Bengard Ranch is a grower and shipper of vegetables, including broccoli, lettuce, cauliflower, celery, radicchio, spinach and mixed lettuce. It is one of the largest grower-shippers in the Western U.S., with farms in California and Arizona and extensive operations in Mexico and Florida.

Arizona’s Minimum Wage to Rise in 2023

Arizona’s minimum wage will rise to $13.85 an hour, up from $12.80 an hour, starting Jan. 1, 2023.

Annual increases are mandated by Proposition 206, which Arizonans approved in 2016. That ballot measure steadily bumped up the minimum wage from $8.05 an hour in 2016 to $12 an hour by Jan. 1, 2020. The state’s minimum wage is now tied to inflation, as measured by the Consumer Price Index for urban workers.
