H-2A Visa Leeway Extended Into 2023

The U.S. Department of Homeland Security (DHS) will extend the amendments to certain regulations regarding H–2A workers to August 2023, to provide employers flexibility in hiring workers during the COVID-19 pandemic.

Through this temporary final rule, DHS will allow employees with valid extension of stay H-2A petitions to begin work with a new employer immediately after their petition is received by the U.S. Citizenship and Immigration Services. This rule extends some of the provisions made possible with the April 20, 2020, temporary final rule. This rule is effective for H-2A petitions for extension of stay received by the Department from August 19, 2020, through December 17, 2020.

In response to the numerous California wildfires impacting farm operations and communities around the state, Western Growers has compiled a list of resources detailing produce, farm and worker safety in relation to wildfires.

The following coverages apply during a wildfire crisis:

  • Commercial Property: Commercial Property policies include wildfire and other disaster coverage. WGIS recommends business owners follow the tips below to gauge whether their current policies provide enough coverage:
    • Have your property appraised regularly to be sure it is sufficiently insured if you need to rebuild, replace, or repair.
    • Coverage should be high enough to cover all assets in the event of a loss. Include computers and other equipment, as well as inventory, furniture, and records when calculating assets.
    • Make sure your policy includes coverage for business interruption to cover costs while in the rebuilding phase.
    • Consider valuation coverage options such as margin clauses, agreed amount.
  • Crop Insurance: Crop Insurance can reimburse growers for losses incurred by natural and other disasters.

COVID-19 Employee Health and Food Safety Checklist Now Available

To assist the food industry as it navigates changes to operations related to COVID-19, the Food and Drug Administration (FDA) and Occupational Safety and Health Administration (OSHA) have developed an “Employee Health and Food Safety Checklist for Human and Animal Food Operations during the COVID-19 Pandemic.” 

The checklist is designed to serve as a quick reference when assessing employee health, social distancing and food safety within the workplace. Pulling from existing guidance provided by the FDA, OSHA and the Centers for Disease Control and Prevention, the checklist is divided into two distinct sections. The first section focuses on employee health, screening and operation configuration for social distancing, while the second section highlights food safety requirements that can help assess the potential impact of COVID-19-related operational changes on food safety practices.
